During investigation, LPA Tran inspected facility's doors and gates, interviewed 4 staff on 08/09/2022, and interviewed 2 staff on 08/31/22 and attempted to interview subject child on 08/11/2022 and 6 children on 09/27/2022. LPA Tran also reviewed facility Parent's Handbook.
On 3 different occasions 08/09/2022, 08/31/2022 and 09/27/2022, LPA Tran observed and inspected all doors and gates in the facility, all doors were being kept closed and gates were locked during the visits.
During staff interviews, 6 out of 6 staff gave consistent answers about giving redirections and standing by the door to prevent the children from running out of class. All interviewed staff denied that they have witnessed any incident that any child left the classroom unsupervised. All 6 interviewed staff described disciplinary policy as giving redirections, giving child time to calm down and informing Director and parents of child's behaviors and staffs denied that they ever withheld food or made any child staying in the playground and in the heat as part of the disciplinary action. All interviewed staff shared concerns about subject child's behavior including running out of the classroom without permission, being disruptive during nap time and being aggressive towards other children and staff. Staff denied treating child differently due their relationship with child but rather to support child to receive the appropriate level of care.
During children interviews, 7 out of 7 children did not qualify for the interviews.
During record review, LPA Tran verified that facility disciplinary policy includes redirections, time for child to think about their behaviors and positive responses from teachers.
Based on LPA 's observations on 08/09/22, 08/31/2022 and 09/27/2022, interviews conducted with 6 staffs and 7 children and record review of facility's Parent's Handbook, there is insufficient evidence to corroborate the allegations that staff do not prevent children from leaving the classroom unsupervised, staff inappropriately disciplined child, staff did not ensure child was accorded dignity in their personal relationships with staff, and staff did not maintain a comfortable temperature for child at all times. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove that staff do not prevent children from leaving the classroom unsupervised, staff inappropriately disciplined child, staff did not ensure child was accorded dignity in their personal relationships with staff, staff did not maintain a comfortable temperature for child at all times, did or did not occur, therefore the allegations that staff do not prevent children from leaving the classroom unsupervised, staff inappropriately disciplined child, staff did not ensure child was accorded dignity in their personal relationships with staff, staff did not maintain a comfortable temperature for child at all times are UNSUBSTANTIATED.
