On 08/04/2023 LPA interviewed Reporting Party (RP) who stated staff made light of the situation and stated the child was fine and did not need to be picked up. RP sent LPA Emergency Room discharge diagnosis forms and a photo of C1’s injuries.
During LPA’s initial visit on 08/04/2023, LPA interviewed Acting Director Kristen Schouw and Preschool Board Chair Jan Flores who joined later during LPA’s visit. Kristen stated she and Staff #2 (S2) were both in view of the children and observed C1 fall. Kristen states C1’s foot did not make it over the sandbox wall and only saw 1–2-inch cat scratch on their right cheekbone. Kristen noticed a bump begin to form and applied ice. Kristen retrieved the Ouch Report book and called C1’s parents. Kristen explained that C1 did not cry, there was no blood and their injury protocol was followed. Kristen, Preschool Board Chair Jan Flores and Director Mindy Weiss, all agreed an Unusual Incident Report did not have to be filed with the Licensing Office and only documented the incident to file internally.
On 08/04/2023, during LPA’s interviews with 3 staff members, all 3 staff were able to convey their protocol for child injuries. 3 out of 3 staff stated children are checked for any visible signs of injury and apply first aid. 3 out of 3 staff members stated parents are called immediately following a head injury.
On 08/22/2023, LPA conducted a subsequent visit and interviewed 7 children. All 7 children stated their teachers supervise them. 3 out of 7 children stated their teachers provide bandages. 3 children also mentioned their teachers “take care of me”, “tell me it’s going to be okay” and “make me feel better”.
LPA attempted to interview 4 parents, but 2 parents were unavailable and did not return LPA’s call. 2 out of 2 parents provided positive feedback regarding the facility staff. Parents did not disclose any pertinent information related to the complaint allegation.
Based on LPA’s interviews with Acting Director Kristen Schouw, 3 staff and 7 children, the preponderance of evidence standard has been met, therefore the above allegation child sustained injury while in care is substantiated. California Code of Regulations, Title 22, Division 12, 101223(a)(2) Personal Rights is being cited on the attached LIC9099D.
