Licensing Program Analyst (LPA) Giselle Lucero conducted an unannounced complaint inspection on today's date 06/22/23. This is a continuation of the investigation initiated on 05/26/2023. Upon arrival LPA met with Director Monique Gonzalez to deliver complaint findings. At 8:45 AM LPA conducted a tour of the facility and census of children was taken. LPA observed 33 preschool children and 4 preschool staff eating breakfast.

A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 05/17/2023 a complaint was filed with the Department alleging (1) staff did not provide a safe and comfortable environment for daycare children and (2) facility is operating out of ratio.

During the course of the investigation, LPA interviewed the Reporting party (RP), 5 staff, 4 parents, and 4 children, conducted a physical plant inspection of each preschool classroom and gathered and reviewed facility documentation and video footage related to the allegations.

During interview with RP, RP stated occasionally there would be 2 staff and 27 children at pick up time. RP does not recall specific dates or times when the staff were out of ratio.

LPA interviewed 5 staff on 05/26/2023, 3 out of 5 staff disclosed preschool teachers are often supervising more than 12 preschool children at one time for about 5-10 minutes, this is due to a shortage in staff and waiting for another teacher to arrive to their shift.

LPA reviewed video footage received from facility. LPA reviewed footage from 05/09/2023 and observed Staff 1 (S1) returning from outdoors and coming to the classroom with 22 children and was alone in the classroom with 22 children for approximately 5 minutes before staff 6 (S6) entered the classroom.



RP disclosed from observation of the cameras in classroom, the children are never doing quite activities such as painting or coloring, and the classroom was always disorderly with children running around when there were being supervised by one staff.

During initial inspection on 05/26/2023, LPAs Lucero and Duron inspected preschool classrooms and observed classrooms C and D did not have sufficient toys for children in care. LPAs also observed cracked cots, matts with exposed foam that children sleep on, a window screen that is ripped, and an exposed water outlet shut off that has sharp metal around it that is covered with a milk crate in the playground area, which is accessible to the children.

2 out of 5 staff interviewed disclosed there are insufficient amount of toys in classroom C because many toys were donated, and facility had thrown many toys away and have not added more toys in the classroom. In video footage received, LPA observed children standing on empty baskets as a way of playing and observed a child pull another child’s hair to move them away from the basket to continue their playing.

LPA Lucero attempted to contact 11 parents by phone and was able to interview 4 parents. All interviewed
parents stated they did not have any concerns with the facility and made no disclosures. LPA interviewed 4 children. Children interviewed made no disclosures.

Based on LPA’s facility inspection, observations, interviews conducted with reporting party, 5 staff, 4 parents, 4 children, review of video footage obtained, and records reviewed it has been determined that the facility is out of ratio and the facility does not provide a safe and comfortable environment for daycare children. Therefore, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated. California Code of Regulations, Title 22, 101216.3 (a) Teacher-Child Ratio, 101239.1(b)(5) Napping Equipment, 101239.1(a) Napping Equipment, 101239(b) Fixtures, Furniture, Equipment and Supplies, 101238.2(h) Outdoor Activity Space and 101239(m)(1) Fixtures, Furniture, Equipment and Supplies.

LPA Lucero informed Director that this report dated 06/22/23 documents 1 Type A citation. Type A citations shall be posted for 30 consecutive days as there are is immediate risk to the health, safety, or personal rights of children in care.
LPA Lucero informed the Director to provide a copy of this licensing report dated 06/22/23 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with Director Monique Gonzalez. A notice of site visit was posted on the door and must remain posted for 30 days.
Appeal Rights were explained. The Licensee was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.

During interview with Reporting party (RP), RP feels Child 1 (C1) and Child 2 (C2) are being targeted by the facility and the staff are discriminating against them by sending them home frequently. RP stated in the past, the facility never made it aware of C1 and C2’s behavior. RP stated previous director never spoke to RP regarding issues or concerns about C1 and C2. RP stated since the new director has been hired in the last couple of weeks, C1 and C2 have been sent home frequently for behavior and feels the children are being discriminated against.

On 05/26/2023 LPA interviewed 5 staff. 5 out of 5 staff interviewed disclosed since new director has started at the facility, children have been sent home frequently for continuous misbehavior. During staff interview, Assistant director stated misbehaviors include biting, pulling hair, hitting, pushing other children, or hitting and kicking staff members. Assistant director stated children need to have 3 incidents, depending on the severity of the incident, in a day for children to be sent home. In Child Time’s handbook under Individual Behavior Support Approach its states, “if your child continues to exhibit inappropriate behavior over a period of time, you may be asked to participate in a parent-teacher conversation with the director and teacher. Failure to sign a Behavior Intervention Plan and/or cooperate with its terms and conditions are grounds for immediate dis-enrollment.” Staff interviewed disclosed other children have been sent home, not only C1 and C2.

During staff interviews, 5 out of 5 staff disclosed witnessing children misbehaving by biting, pulling hair, and hitting other children. Staff redirect children, apply first aid if needed, and write an incident report and provide it to the parents. Assistant director stated children who constantly misbehave are put on a behavioral plan that is made with the director and the parents for staff to try different strategies to help the child.

LPA Lucero attempted to contact 11 parents by phone and was able to interview 4 parents. All interviewed
parents stated they did not have any concerns with the facility and made no disclosures

LPA interviewed 4 children. Children interviewed made no disclosures.

During the investigation LPA Lucero interviewed the reporting party, 5 staff members, 4 parents, and 4 children. LPA reviewed the children’s roster and facility discipline policy.

Based on the information gathered from LPA's interviews with staff, parents and children there is insufficient evidence to corroborate the allegation, staff discriminate against daycare child and staff do not prevent daycare children from being harmed by each other. Although the allegations may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.

Exit interview was conducted. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
