During the investigation, LPA Lucero interviewed six (6) staff members, four (4) children and three (3) parents.
Staff reported that drinking water is available to children at all times. In classrooms, water is provided through small water jugs, and outdoors on the playground, a large insulated water container is available. Staff stated they maintain extra water jugs in the classrooms to ensure continuous access. If water is unavailable in a classroom, staff contact the office to have water delivered promptly. Staff indicated they have not experienced a situation in which drinking water was unavailable to children.
Staff further stated that morning staff are responsible for cleaning and refilling the large insulated water jug used outdoors. This cleaning occurs daily before children arrive. While staff acknowledged that the exterior of the jug may become dirty by the end of the day due to children touching or playing near it, they emphasized that the water inside remains clean and sanitary.
Staff reported that children drink from disposable cone cups for sanitation purposes. Cups are kept both in classrooms and outdoors. If supplies run low, staff contact the office for resupply. Staff stated there has never been an instance in which the facility ran out of cups.
LPA Lucero also interviewed four (4) children. The children were able to identify where drinking water and cups were located both indoors and outdoors. The children reported they have always been able to access water when needed and stated they would ask a teacher for assistance if necessary.
LPA interview 3 parents. Parents interviewed did not express concerns pertaining to these allegations.
Additionally on 10/08/2025, 12/03/2025, and 12/19/2025, LPA Lucero inspected the classrooms and outdoor areas for the availability of drinking water and disposable cups and observed that both were present.
Based on LPA's interviews and observations, it has been determined there was no preponderance of evidence supporting (1) staff does not ensure water jug is clean and (2) staff does not ensure day care children have access to drinking cups. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are found to be Unsubstantiated.
