Licensing Program Analyst (LPA) Giselle Lucero conducted an unannounced case management incident inspection in response to a self reported Unusual Incident dated 09/19/2023. LPA met with Director Nichole Ontiveros. Director guided LPA on a walk through of the facility and observed 47 preschool age children with 6 staff.

A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. During the visit, it was determined the facility is operating within its licensed capacity and within compliance of staffing ratios.

On 09/20/2023 a self reported Unusual Incident Report (UIR) was filed with the Licensing Office. The facility reported a child being left unattended without any supervision from staff on the playground. Director stated while children were transitioning from the playground back to the classroom. Staff #1 (S1) lead the children inside the classroom and Staff #2 (S2) was standing at the door to ensure the rest of the children entered. Staff #3 (S3) was instructed to bring in Child #1 (C1) that was still on the playground. C1 refused to go with S3. After numerous tries, S3 proceeded to enter the classroom without C1 and let the door close behind them. A grandparent arrived to drop off their child and knocked on the door, letting the staff know there was a child on the playground. S3 assumed there were other teachers outside. District Manager reviewed video surveillance and discovered the door was closed for approximately 44 seconds. Director stated S3 has been terminated, effective 09/20/2023.

On 09/21/2023 LPA interviewed the three staff that were present on the day C1 was left on the playground without staff present.

S1 stated their class was outside on the playground and S1 and S2 started to gather the children to transition back inside the classroom. S2 then headed inside the classroom to start washing the children’s hands for breakfast. S1 stated observing S3 arrive to their shift and walked through the playground gate. S1 disclosed S2 told S3 to grab C1 because they were the last child outside. S2 headed inside and started to change the children’s diapers and after a few minutes, S3 came inside the classroom. S3 was then asked by S1 and S2 where C1 was and then staff heard a knock on the classroom door and saw an adult with C1. S1 stated C1 was left on the playground without staff supervision for approximately 5-6 minutes.

S2 stated S2 and S1 were transitioning the children from outside to inside the classroom for breakfast. S2 observed S3 arrive to the playground and grabbing and walking with C1 towards the classroom. S2 then walked inside to the children’s bathroom to start washing the children’s hands. S3 then walked into the classroom and all three staff were inside the classroom with the door closed. S2 then heard a knock on the door and when the door was opened, staff saw an adult with C1. S2 stated C1 was left on the playground without staff supervision for approximately 5 minutes.

S3 stated they arrived late to their shift and when they arrived, S3 walked through the playground and was in the process of dropping off their child, who is in enrolled in a different classroom. S3 saw the children from S3’s class gathering near the classroom door and saw C1 was still on the playground. S3 then picked up C1 to help bring them inside. S3 stated C1 started to kick them and S3 put C1 back down and assumed S1 and S2 were going to bring C1 inside. S3 walked away from C1 and proceeded to drop their child off to their class. S3 stated the two classrooms are next to each other with a door in between. When S3 finished dropping off their child, S3 walked next door to their class and started to help serve breakfast. S3 then heard a knock on the door and saw a parent with C1. S3 thought S1 and S2 were going to bring C1 inside.

LPA obtained and reviewed video footage of the incident. Camera view shows an angle from the playground, there is no audio in the video footage. C1 is observed playing at a picnic table alone on the right side of the playground. S2 is observed with 4 children walking towards the classroom on the left side of the playground. S2 looks at C1 and continues to walk towards the classroom. S2 is no longer in camera view. S3 is then observed walking in through the playground gate with S3’s child. S3 is observed picking up C1 by the armpits and walked a couple feet, C1 then started to kick and S3 put C1 down. S3 walks away from C1, C1 is observed walking back towards the picnic table. S3 is no longer in camera view. Approximately a minute and 30 seconds later, an adult is observed walking in the playground with a child and looks over to C1 while walking away. Adult and child then walk out of camera view. C1 is then observed running towards the classroom and out of camera view. It is unclear how long C1 was left unsupervised.

Based on LPA's staff interviews and video footage obtained, it has been determined that C1 was left on the play yard on 09/19/2023 without staff supervision.

The following violation Responsibility for providing care and supervision was revealed today and is being cited in accordance with California Code of Regulations, Title 22, Division 12, Chapter 1, 101229 (a)(1). Please see the attached LIC 809D.

LPA Lucero informed Director Nichole Ontiveros that this report dated 05/31/2024 document(s) one Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Lucero informed Director Nichole Ontiveros to provide a copy of this licensing report dated 05/31/2024 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with Director Nichole Ontiveros. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.
