RP stated C1 continued to cry, and staff ignored C1 because staff were involved in other tasks. RP stated no marks or injuries on C1 were observed.
During the investigation LPA Lucero interviewed 3 staff members, 5 parents and obtained facility roster.
During staff interviews conducted on 03/07/2024 ,staff interviewed stated staff have newly enrolled children sit with their peers and if the child is crying, staff comfort them, but not for a long period of time because staff have other children to attend to and other tasks to complete. Staff disclosed children are also comforted verbally while staff are completing other tasks. Staff also stated children with challenging behaviors are redirected and spoken to about respecting their friends and keeping their hands to themselves. Staff denied not comforting a child when they are upset and denied ever observing other staff not comfort a child. Staff also denied not intervening when a child hits another child and denied observing other staff not intervene.
LPA attempted to interview children: however, children were unable to be interviewed due to their age.
LPA interviewed 5 parents. Parents interviewed made no disclosures.
Based on LPAs interviews, it has been determined there was insufficient evidence (1) staff did not prevent a day care child from harming other children and (2) staff did not attend to the needs of day care children.
Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.
Exit interview conducted and report was reviewed with the Director Nichole Ontiveros. A notice of site visit was given and must remain posted for 30 days.
Appeal Rights were explained. The Director was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
