Licensing Program Analyst (LPA) Giselle Lucero conducted a complaint visit regarding the above complaint allegation. LPA observed 52 preschool children with 5 staff in the classrooms during nap time.

A review of facility Personnel Report Summary on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Department received a complaint on 02/11/2025 alleging staff was playing roughly with child. Reporting Party (RP) reported on 02/07/2025, RP observed Staff #1 (S1) playing roughly with a Child #1 (C1). C1 was observed approaching S1 and appeared to be punching S1’s mid-section area. S1 was observed to play fight back. RP stated C1 grabbed a tray that was used for activities and attempted to hit S1 with tray. S1 was able to take tray away from C1 by grabbing it and pretending to hit C1 on the head.

During the investigation LPA Lucero interviewed 5 staff, 6 parents, interviewed 1 preschool child and attempted to interview C1.

On 02/14/2025, LPA requested video footage of the alleged incident, however video footage was unable to be obtained.

During staff interviews, S1 disclosed they would pretend fight by throwing air punches to C1 because C1 would approach S1 to initiate it, however they never physically touched C1 during these play fights and it was always playful. S1 stated they were spoken to by the Director regarding the concern that was brought to their attention by a parent and since then has stopped play fighting with C1. S1 stated they let C1 know that they can no longer play fight. LPA conducted staff interviews. Staff interviewed expressed no concerns regarding S1 and stated they have not observed S1 play roughly with children.

LPA attempted to interview C1, but C1 did not want to be interviewed by LPA. LPA attempted to interview 5 preschool children in C1's classroom however, 4 out of 5 children were not qualified for interview. Child interviewed made no disclosures.

LPA interviewed 6 parents. Parents interviewed made no disclosures and expressed no concerns.

Based on LPA's interviews, it has been determined there was no preponderance of evidence supporting staff was playing roughly with child. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is found to be Unsubstantiated.

Exit interview was conducted with Director Nicole Ontiveros. The Notice of Site Visit was posted.
