Licensing Program Analyst (LPA) Giselle Lucero conducted an unannounced case management incident inspection in response to a self-report Unusual Incident dated 08/30/2024. LPA met with Director Nichole Ontiveros. LPA observed 15 infants with 3 staff during nap time.

A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 09/03/2024 a self-reported Unusual Incident Report (UIR) was filed with the Licensing Office. The facility reported on Friday August 30, 2024, Parent #1 (P1) called the facility to report an incident that was observed on the facility's camera involving P1's child (C1). P1 reported Staff #1 (S1) was observed grabbing C1’s arm and put their finger in C1's face saying no.

On 09/06/2024, LPA interviewed staff and requested the video footage of the incident.

During staff interviews, S1 stated the class was transitioning for lunch and S1 recalls standing at the shelf area and had a child (C2) by their legs. C1 approached them and pushed C2 down into the shelf. S1 stated they crouched down, picked up C2, and still at eye level with the children, turned their attention to C1. C1 was about to run away and S1 redirected C1 back, S1 used their finger for emphasis, and told C1 "we do not push our friends" and C1 walked away. S1 stated they handle children with challenging behaviors by redirecting children by presenting them with toys that can occupy them from the incident.

On 10/15/2024, LPA received video footage of the incident, video footage has no audio. LPA reviewed video footage and observed S1 standing at a shelf area. C1 and C2 walk towards S1 and are standing by S1’s legs. C1 then pushes C2 and both children fall. S1 crouches down and attends to children. C1 stands up and S1 points at C1. C1 begins to walk away and S1, still crouched down, grabs C1 by the shirt's collar, lets go of shirt, and then grabs both of C1’s arms and brings C1 closer to S1's face. C1 is close to S1’s face and S1 is observed talking to C1 while still holding onto C1’s arms. S1 then lets go of C1 and attends to C2. C1 walks away and plays with a chair.

LPA did not interview children due to children being infants.

Based on video footage reviewed it has been determined staff used intimidation to redirect child. Therefore, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated. California Code of Regulations, Title 22, 101223 (a)(3) Personal Rights is being cited on the attached LIC 9099D.

Exit interview conducted and report was reviewed with Director Nichole Ontiveros. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
