During the investigation LPA Lucero interviewed 5 staff members, 4 parents, conducted a facility inspection, took pictures of the physical plant, and reviewed the children’s roster.
During staff interviews conducted on 10/04/2023, Staff #1 (S1) disclosed there are 3 sinks in the infant classroom, staff wash their hands after changing diapers in the kitchen sink located in the infant classroom if the other two sinks located in the classroom are occupied. Staff #2 (S2) stated staff wash hands in the staff restroom that is in the classroom or use the sink at the 2nd baby changing area. S2 denied observing staff wash their hands in the kitchen sink. Staff #3 (S3) stated there are three sinks in the infant classroom, but one of the sinks that is located next to the changing table has been in disrepair for some time, and due to this staff have been using the kitchen sink to wash their hands after changing diapers. Staff #4 (S4) stated the sink next to the changing table has been out of order for about 4 months and staff have been using the kitchen sink to wash their hands after changing diapers. Staff #5 (S5) stated the sink located next to the changing table has been out of order for a while and has not been fixed due to having to wait for the approval from the board for the cost of the repairs. S5 stated the church’s board has recently approved to proceed with fixing the water pipes.
During facility indoor inspection on 10/04/2023, LPA Lucero observed a sink next to the changing table and had no running water coming out of the faucet. LPA Lucero recorded a video of LPA turning water faucet and no running water coming out.
On 10/11/2023 LPA attempted to interview 12 parents, however only 4 parents were available for interview. Parents interviewed made no disclosures. LPA did not interview children due to infants’ age and infants being nonverbal.
Based on LPA’s facility inspection, pictures taken of the physical plant, interviews conducted with 5 staff members, 4 parents, and records reviewed, it has been determined (1) Facility is unsanitary and (2) Facility is in disrepair. Therefore, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated. California Code of Regulations, Title 22, 101439(h)(4) Infant Care Center Fixtures, Furniture, Equipment and Supplies and 101439(h)(5) Infant Care Center Fixtures, Furniture, Equipment and Supplies are being cited on the attached LIC 9099D.
