Licensing Program Analysts (LPA) Giselle Lucero and Cynthia Sun conducted an unannounced complaint inspection to deliver the findings for the above allegations. This is a continuation of the investigation initiated on 10/04/2023. Upon arrival LPAs met with Director, Lisa Cottrell. Director guided LPAs on a tour of the facility. At 12:20 PM LPAs observed a total of 14 infants with 4 staff.

A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The department received a complaint on 09/27/2023 alleging (1) Facility is unsanitary and (2) Facility is in disrepair. Reporting Party (RP) stated observing staff using the kitchen sink to wash their hands after changing diapers and not using the sink next to the changing table.

During the investigation LPA Lucero interviewed 5 staff members, 4 parents, conducted a facility inspection, took pictures of the physical plant, and reviewed the children’s roster.

During staff interviews conducted on 10/04/2023, Staff #1 (S1) disclosed there are 3 sinks in the infant classroom, staff wash their hands after changing diapers in the kitchen sink located in the infant classroom if the other two sinks located in the classroom are occupied. Staff #2 (S2) stated staff wash hands in the staff restroom that is in the classroom or use the sink at the 2nd baby changing area. S2 denied observing staff wash their hands in the kitchen sink. Staff #3 (S3) stated there are three sinks in the infant classroom, but one of the sinks that is located next to the changing table has been in disrepair for some time, and due to this staff have been using the kitchen sink to wash their hands after changing diapers. Staff #4 (S4) stated the sink next to the changing table has been out of order for about 4 months and staff have been using the kitchen sink to wash their hands after changing diapers. Staff #5 (S5) stated the sink located next to the changing table has been out of order for a while and has not been fixed due to having to wait for the approval from the board for the cost of the repairs. S5 stated the church’s board has recently approved to proceed with fixing the water pipes.

During facility indoor inspection on 10/04/2023, LPA Lucero observed a sink next to the changing table and had no running water coming out of the faucet. LPA Lucero recorded a video of LPA turning water faucet and no running water coming out.

On 10/11/2023 LPA attempted to interview 12 parents, however only 4 parents were available for interview. Parents interviewed made no disclosures. LPA did not interview children due to infants’ age and infants being nonverbal.

Based on LPA’s facility inspection, pictures taken of the physical plant, interviews conducted with 5 staff members, 4 parents, and records reviewed, it has been determined (1) Facility is unsanitary and (2) Facility is in disrepair. Therefore, the preponderance of evidence standard has been met, therefore the above allegations are found to be Substantiated. California Code of Regulations, Title 22, 101439(h)(4) Infant Care Center Fixtures, Furniture, Equipment and Supplies and 101439(h)(5) Infant Care Center Fixtures, Furniture, Equipment and Supplies are being cited on the attached LIC 9099D.

Exit interview was conducted. Notice of Site Visit was posted during the visit. Director Lisa Cottrell was informed that the notice of site visit must be posted for 30 consecutive days. Reporting Party (RP) stated the infant play area has dead grass and a lot of dirt. RP disclosed the infants play outside in the dirt. The RP stated that multiple times the RP’s child comes home dirty, and the RP noticed dirt inside their child’s nose. Co-complainant (CC) also reported seeing toddlers play in the dirt area and eat dirt. CC stated the children end up very dirty. CC also disclosed observing boxes that are not in use near the baby room for months and is not a safe keeping of stacked boxes.

During the investigation LPA Lucero interviewed 4 staff members, 4 parents, conducted a facility inspection, took pictures of the physical plant, and reviewed the children’s roster.

During staff interviews conducted on 10/04/2023, Staff #1 (S1) disclosed the outdoor infant play area has had grass and exposed dirt since June 2023. S1 also stated infants get dirty from playing outside but get wiped down with wipes when infants come inside the classroom. S1 also stated if extra clothes are brought from the parents are available, staff change the infant’s clothing if needed. S1 denied ever observing a child leave home dirty. S1 stated staff clean the infants outside toys and inside toys in the morning and at the end of the day. Staff #2 (S2) stated infants get dirty from playing outside but staff wipe them down using wet towels and change their clothing if needed. S2 denied ever observing a child leave home dirty. Staff #3 (S3) stated staff clean the infant’s face and hands with wet towels once staff bring the children inside. S3 also stated staff change infant’s clothing if their clothing is dirty, if an infant does not have extra clothes available, staff try to clean their clothing as much as they can. S3 denied ever observing an infant leave home dirty during S3’s shift. Staff #4 (S4) stated if an infant falls while playing outside, staff wipe the infant down, as well as cleaning them when they come inside to eat. Staff wipe the infants with warm wet towels and staff also make sure infants are clean before they go home. S4 stated observing some infants going home with their clothes dirty but not infant’s faces.

During facility inspection on 10/04/2023, LPA Lucero observed 3 boxes stacked on top of strollers in the facility’s hallway on the outside of the infant’s classroom door and inaccessible to the children in care. LPA also inspected infant outdoor play yard. Play yard was observed to have grass and dirt.
On 11/17/2023 LPA attempted to interview 12 parents, however only 4 parents were available for interview. All parents interviewed are satisfied with the childcare facility and did not have any concerns.
LPA did not interview children due to infants’ age and infants being nonverbal.

Based on LPA’s interviews conducted with the 4 staff and 4 parents, it has been determined there was insufficient evidence that (1) Staff do not provide a comfortable environment for day-care children, (2) Staff do not provide a safe environment for daycare children and (3) staff do not meet child's hygiene needs. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.

Exit interview conducted and report was reviewed with Director Lisa Cottrell A notice of site visit was given and must remain posted for 30 days.

Appeal Rights were explained. The Licensee was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
