25 | On 10/11/2024, Licensing Program Analyst (LPA) A. Silva conducted a Case Management – Deficiencies visit. Upon arrival, the LPA met with licensee Esther Gudino. An on-site Facility Personnel Report Summary review indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Census was 4 children. The facility was operating within ratios and capacity.
During the tour, the LPA observed one infant (C1) sleeping in the bedroom with the door closed. The licensee was informed that according to 102425(j)(5)(A) Infant Safe Sleep the provider shall supervise infants while they are sleeping and adhere to the following requirements: (5) If the infant is sleeping in a separate room from where the provider is stationed, the door to the room the infant is sleeping in shall remain open at all times. (A) The provider shall be able to visually observe the infant without moving the door.
During the visit, the LPA observed a saucer chair and a rocking chair in the daycare area. The licensee was informed that according to CCR 102417(g)(10) Operation of A Family Child Care Home, A baby walker (and similar items like saucer chair and rocking chairs) shall not be allowed on the premises of a family child care home in accordance with Health and Safety Code Sections 1596.846. The licensee removed the articles from the daycare area. The licensee stated the parent brought the saucer chair for C2.
The facility was not in compliance. Deficiencies of the CCR Title 22 regulations were observed and cited during the visit, including: 102417(g)(10) Operation of A Family Child Care Home and 102425(j)(5)(A) Infant Safe Sleep.
Appeal Rights were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was provided and must remain posted for 30 days. Exit interview conducted and report was reviewed with the daycare representative.
