Complainant alleged that there have been several times that a child disrupts the other children during napping. Complainant stated that the child runs into the classroom, shouts, cries, and throws toys on the floor during nap time which wakes the other children. Per complainant, staff have tried different strategies to redirect the child like giving the child books or stuffed animals, and quiet activities at the table such as puzzles, playdough, crayons, paint, and markers but nothing works.
During the staff interview, all the staff interviewed stated that the facility is always within compliance with children's personal rights regulation. Staff #1, #2, and #3 (S1, S2, S3) stated that they have tried different strategies to redirect the child during nap times, but it hasn’t been working. S1-S3 do feel that the child sometimes disrupts other children from napping. Staff #4 (S4) stated that the facility continues to come up with new strategies to work with the child.
LPA called 7 parents and left message for return calls. The four parents interviewed did not express any concerns.
LPA attempted to interview six children, however; the children were not qualified for the interview due to being too young (non-verbal).
Based on LPA observations on 02/12/2024 of staff directing the child, document reviews of the development of a behavior intervention plan and interviews which were conducted, the preponderance of evidence was not met, therefore the above allegation is found to be UNSUBSTANTIATED. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED.
Exit interview was conducted with Director, Pauline Abu-Tayeh, LPA issued a technical violation to the facility. The Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above. |
