During the investigation, LPA Lucero interviewed seven (7) staff members, two (2) children and three (3) parents.
During interviews with the children, Child #1 (C1) reported that they were playing on the carpeted area when Child #2 (C2) asked them to move. C1 stated they were not interfering with C2’s play. According to C1, a verbal disagreement occurred, which escalated into a physical altercation. C1 alleged that C2 grabbed their wrist in an attempt to move them, and in response, C1 punched C2’s hand. C1 further stated that Staff #1 (S1) approached, grabbed C1’s wrist, and pulled them off the carpet.
LPA was unable to interview C2. LPA also interviewed Child #3 (C3), who was present at the time of the alleged incident. C3 reported no concerns regarding S1 and stated they did not recall observing S1 grab C1 or pull them off the carpet.
During staff interviews, S1 denied the allegation. S1 stated they were the only staff member present at the time and described the incident as a verbal disagreement between C1 and C2 that escalated into a physical altercation. S1 reported intervening to de-escalate the situation and redirect C1 away from the carpeted area. S1 stated they lifted C1 from behind and moved them off the carpet in a non-aggressive manner. S1 further stated that management later spoke with them as a reminder of the center’s hands-off policy. S1 explained that they intervened due to concerns about maintaining a safe environment. Other staff members interviewed did not report any concerns or make disclosures regarding S1.
The LPA was unable to obtain video footage of the alleged incident. The LPA interviewed three parents, none of whom expressed concerns related to the allegations.
Based on LPA's interviews, it has been determined there was no preponderance of evidence supporting there was a violation of personal rights. regarding the allegation stating "staff picked up child and moved child due to child not listening". Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is found to be Unsubstantiated. Exit interview was conducted with Director Jennifer Gardea. The notice of site visit was posted.
