During investigation, LPA interviewed six (6) staff and contacted seven (7) parents. Four (4) out of six (6) interviewed staff disclosed that they had witnessed Staff 1 (S1) yell at a child. The two (2) remaining staff stated they had not heard S1 yelling at children in care. Three (3) out of six (6) staff stated they had witnessed S1 handle a child in a rough manner. Four (4) of out six (6) staff stated they felt uncomfortable with the way S1 handled preschool children. Regarding parent interviews, Two (2) out of seven (7) parents interviewed did not disclose concerns regarding the allegations. Five (5) parents did not answer. LPA attempted to interview four (4) children, but none were eligible to be interviewed.
During record review, it was discovered that S1 had been previously written up for misconduct back in November 2025, specifically for yelling at a child in care. During interview with acting director, it was discovered that S1 had been placed on suspension, still pending review from District Leader.
The Orange County Regional Child Care Licensing Office has investigated the complaint alleging that 1) Staff handled day care child in a rough manner and 2) Staff yelled at day care child. Based on information gathered from LPA’s interviews and record reviews, the preponderance of evidence standard has been met, therefore the allegations are substantiated. A type A deficiency was cited in accordance with California Code of Regulations, Title 22, Division 12 & Chapter 1, Section 101223(a)(3) for Personal Rights during today's inspection. Refer to LIC9099-D for more details.
Due to the Type A violation being cited today, the licensee shall post and provide copies of the report to parents/guardians of the children in care at the facility by the next business day, and shall provide to the parents/guardians of children newly enrolled at the facility during the next 12 months. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days and provide a copy to current and enrolling parents. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child’s file. Failure to post Type A reports for 30 days will result in a Civil Penalty of $100.00
A notice of site visit was given and must remain posted for 30 days.
