Complainant Party (CP) reported that the facility the facility was out of ratio on 11/30/22 at about 4:00pm with only an assistant teacher present. CP also reported that there was one child who was walking around classroom with wet clothes and two children were playing with water from the sink.
During the investigation, LPA interviewed Director and three teachers and all stated they do not leave one teacher alone with more than 12 children. LPA interviewed assistant teacher who was present on 11/30/22 and assistant teacher also stated that s/he was not alone with more than 12 children. Staff #3(S3) and S#4 stated they go to the closing classroom (Room #3) after all their infants have gone home. Both S3 and S4 indicated they were in Room #3 at about 4:00pm and S1 and S2 were present . LPA reviewed attendance for that date and at the time of the allegation there were 27 children present . LPA reviewed staff time sheets for that date and LPA verified there were four teachers and assistant teacher present. LPA attempted to interview 5 parents but only 2 returned calls. Both parents did not divulge any information which indicated facility was out of ratio. LPA was unable to corroborate the allegation.
Based on LPA’s facility inspection, observations, interviews conducted with director, 4 staff members, and records reviewed it was determined there was insufficient evidence that facility was out of ratio. . Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.
In reference to the allegation that Day-care children are not adequately supervised. LPA interviewed four staff who were present on 11/30/22 in classroom #3. All four staff indicated they never left children unsupervised and none could recall any children walking around with wet clothing or any children playing with water. One staff did state that the children occasionally try to play with water from the sink but staff redirect them. This staff also indicated that s/he could not recall seeing a child walking with wet clothing.
