On 08/02/22, Licensing Program Analyst (LPA) Tran conducted an in-person investigation to deliver the findings regarding allegations that staff handled child(ren) in a rough manner, child care center is not safe at all times to ensure the safety and well-being of children, employees and visitors, staff left feces on child(ren) as a form of discipline. LPA Tran met with Director Jasmin Canales.

A tour around the facility was conducted, and a census was taken. Observed at the time of the visit was a total of 29 preschool children and 6 staff members.

A review of the Facility Personnel Report Summary on 08/02/2022 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 05/03/2021, the Regional Office received a complaint with allegations alleging staff handled child(ren) in a rough manner, child care center is not safe at all times to ensure the safety and well-being of children, employees and visitors, staff left feces on child(ren) as a form of discipline.

During the course of investigation, LPA Tran interviewed 8 staff on the initial 10-days investigation at the facility on 05/11/2022. On 07/18/2022, LPA Tran conducted a subsequent investigation and interviewed 5 children. LPA Tran also reviewed facility’s documentation of communication with parents and management team and staff training. LPA also observed afternoon pick-up procedure on 05/11/2022, and morning drop-off procedure 07/18/2022 and on 08/02/2022 from the front lobby of the facility.

During interviews, LPA Tran interviewed 8 staff at the facility on 05/11/2022. All 8 out of 8 interviewed staff denied that they had ever witnessed any staff handling children in rough manner, front door being left open unattended, any stranger entering the facility without verification, and staff not changing children's diapers to teach them a lesson. All 8 interviewed staff provided consistent answers about facility's effort in reminding parents to lock their cars and not leaving belongings during drop-offs and pick-ups, and about diaper changing procedure as scheduled every 2 hours and change as needed in between. All 5 out of 5 interviewed children on 07/18/2022, denied getting hurt by staff as result of rough handling or witnessing any other children getting hurt by staff.

During record reviews, LPA Tran reviewed facility Newsletters, which was sent to parents via email and posted in the facility bulletin, with reminders for parents to keep their car’s doors locked and not to leave belongings in the vehicle to reduce break-ins during drop-offs and pick-ups. LPA Tran also reviewed written communication that Director had with management team regarding installing more lights and cameras for facility parking lot and on the side of the facility. In addition, LPA Tran reviewed facility’s staff training document that staff was trained on how to handle children with positive guidance techniques and refraining from any unacceptable measure including physical discipline in order to maintain safe environment for all children in care.

On 3 different occasions, during the visits at the facility, LPA Tran observed pick-up procedure on 05/11/2022 from 4pm – 4:30pm, and drop-off procedure on 07/18/2022 and on 08/02/2022 from 8am – 10am. During the observations, the front door of the facility was always closed and locked, all parents and staff used their codes to open the door and the door was never left open unattended. LPA Tran also observed signs were posted on the front door to remind parents to keep the door closed behind them and do not hold doors for others to enter.

Based on the information gathered from LPA's observations on 05/11/2022, 07/18/2022 and 08/02/2022, interviews conducted with 8 staffs on 05/11/2022 and interviews conducted with 5 children on 07/18/2022, and record reviews of staff training, facility’s Newsletters and Director's written communication with management team, there is insufficient evidence to corroborate the allegations that staff handled child(ren) in a rough manner, child care center is not safe at all times to ensure the safety and well-being of children, employees and visitors, staff left feces on child(ren) as a form of discipline, therefore, the allegations regarding staff handled child(ren) in a rough manner, child care center is not safe at all times to ensure the safety and well-being of children, employees and visitors, staff left feces on child(ren) as a form of discipline are unsubstantiated.

Exit interview was conducted. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100. “The licensee was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights.” This report LIC 9099 was provided to the director Jasmin Canales. First level appeal is to Regional Manager, address is above on the report.
