Licensing Program Analyst (LPA) Carmen Odom conducted an unannounced complaint inspection to investigate the above allegations and deliver findings. This is a continuation of the investigation initiated on 05/04/2022.

Upon arrival LPA met with Director, Lynn Porter who guided LPA on tour of the facility. LPA observed a total of 64 preschool age children with 7 staff. There were 8 preschool age children with 1 staff in room 2A, 11 preschool age children with 2 staff in room 2B, 11 preschool age children with 1 staff in room 3A, 12 preschool age children with 1 staff in room 3B, and 22 preschool age children with 2 staff in room 4A.
A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The department received a complaint on 4/28/2022 alleging staff conduct poses a risk to children in care. Reporting party (RP) stated on 4/28/22 there was an altercation between RP from the apartment complex and the childcare staff regarding shared parking spots. RP alleged that during the altercation staff were yelling at RP in the presence of 1 childcare child.

During the investigation LPA Odom interviewed Reporting Party, Director, 3 Staff members, 1 adult, 1 witness, pictures taken by LPA, pictures obtained, requested for children’s roster, and personnel report. According to police department records there was no police report made on the day of the incident. Children and parents were not interviewed due to enough information gathered and none being present during the incident.

During an interview on 05/04/22, Director stated, they weren’t present during the incident that occurred in the shared parking lot located about 65 feet away from the front of the childcare entrance where parents do not drop off children. Director stated they have a yearly lease with the apartment complex for 9 parking spots to be used for the childcare staff from 6:00am to 7:00pm, if anyone is parked in the 9 parking spots during those hours they will be towed away. There are large signs posted in front of the parking spots. LPA observed the posted sign. On 4/28/22 RP had parked illegally on one of the parking spots, Staff #3 (S3) called the tow truck company to tow the vehicle away. The tow truck arrived and was about to tow the vehicle away when RP came outside and got inside the vehicle. S3 was outside assisting Adult #1 (A1) with the situation. There is a 7-foot wall brick between the toddler’s playground and parking lot, but the toddlers do not go outside until 9:30am and the incident occurred around 8:30am.

Three staff members were interviewed on 5/4/22 and 6/1/22. S2 stated on 4/28/22 at around 8:37am S3 told S2 they were going to call the tow truck company because there was a vehicle parked illegally since 7:25am. The tow truck company arrived around 8:40am to tow the vehicle away, at 8:53am A1 called S3 to come outside to the parking lot to assist with a situation. S3 went outside to assist A1 with the altercation between RP and A1. Staff #4 (S4) observed the RP inside the vehicle while the vehicle was already hooked up on the tow truck.

RP agreed to pay for the drop fee and the vehicle is not towed away. S3 stated on 4/28/22 they arrived at the childcare facility at 7:25am and took a picture of the vehicle that was parked illegally, they waited for 10 minutes to let them know that they were parked illegally but the owners of the vehicle never came out. At around 8:30am the vehicle was still parked illegally so S3 called the tow truck company to tow the vehicle away. S3 stated A1 called S3 to come outside to the parking lot because there was a dispute with the owner of the vehicle. S3 tried speaking to RP but RP was upset and yelling. Eventually RP was able to come to an agreement with A1 and the vehicle was not towed away. Staff #2 (S2) stated they went outside with their child to make sure S3 was safe, they observed for 2 minutes from a distance about 25 feet away from the altercation and went back inside. S2 stated they were not involved in the altercation with RP.

During the investigation Adult #1 (A1) was interviewed on 5/17/22. A1 confirmed the statement provided by S2, S3, and S4. A1 had called S3 to come outside to the parking lot and assist with a dispute. A1 stated S3 tried talking to RP but RP was upset and yelling at A1 because they were towing their vehicle away. A1 stated there were no childcare children present at any moment during the altercation in the parking lot which is located away from the childcare entrance.

During the investigation Witness #1 (W1) was interview on 5/27/22. W1 stated they observed a blond staff member with a child from a distance observing the altercation.

Based on LPA’s facility inspection, observations, interviews conducted with complainant party, director, 3 staff members, 1 adult, 1 witness and records reviewed it was determined there was insufficient evidence to that staff conduct poses a risk to children in care. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.

Exit interview was conducted with Director, Lynn Porter. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
