Director was advised on 1/27/2023 that the Lead Sample Report was to be posted. Director stated the outlet K in infant room with a high level of lead at 5.5, was made inoperable and the test result was posted on 01/27/2023. Kinder Care has sent staff to replace the faucet K on January 12, 2023. The directed states that outlet K continues to be tested and is scheduled to be retested again by February 17, 2023. In the meantime, water is being brought from the kitchen in a water purified pitcher to be used in the infant rooms.
During todays visit LPA’s verified that outlet K is not in use and being flushed throughout the day. There is a list posted above the sink with testing dates done by teachers. There is also a sign to not use the sink. During today’s visit LPa’s also verified that test sample results were posted and verified documentation that the facility had taken to fix outlet K.
Based on LPA's observation, interview with Director, review of facility's sketch and documentation regarding action taken to fix the identified outlet, the following violation was observed and in accordance with Written Directives Section 101700.3 (b)(1) California Lead Action Level at Child Care Centers is being cited on the attached LIC 809D.
Exit interview conducted and report was reviewed with Assistant Director Victoria Lopez . A notice of site visit was given and must remain posted for 30 days.
Appeal Rights and deficiency were explained. The Director was provided a copy of appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
