On 03/10/2026, Licensing Program Analyst (LPA) Long Pham conducted an unannounced complaint inspection for the purpose of delivering findings. Upon arrival at 9:05am, LPA met with the director Wendolin Hernandez and was led on a tour of the facility. LPA observed a total of 27 preschool children with 9 staff. This is a continuation of a complaint inspection initiated on 01/08/2026.
A review of the Facility Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. During today’s inspection the facility was operating within its licensed capacity and within compliance of staffing ratios.

On 01/07/2026, the Orange County Child Care Office received a complaint alleging (1) Unqualified adults are providing care and supervision to day care children and (2) Staff left daycare children unattended. Reporting Party (RP) stated that on 09/18/2025, Staff #1 (S1) and staff #6 (S6) were in the classroom from 5:00 PM- 5:30 PM to close.

Parent #6 (P6) came to pick up their child # 2 (C2), who had a bowel movement. P6 asked staff to change C2. Staff #1 (S1) left the classroom to take C2 to the bathroom. RP stated that S1 had been left alone with children on multiple occasions. RP stated that child #1 (C1) ran out of classroom #3, down the hallway, past the front office area, and out the front door portable into the parking lot. RP stated that S6 asked P6 stayed in the classroom with the children and to inform S1 while S6 went out to bring the child back into the classroom. RP stated that S6 ran out to bring the child back in and at that time C1 was already in the parking lot.

During the investigation, LPA toured the facility and obtained pertinent documents. LPA also conducted interviews with the reporting party, 5 staff members, 6 parents, and 5 children.



Regarding the allegation of “Unqualified adults are providing care and supervision to day care children”

During the staff interview, 5 out of 5 staff denied the allegation of “Unqualified adults are providing care and supervision to day care children” and stated that they are all qualified teachers. During the initial 10-day visit, LPA reviewed all staff files including S1 and S6 file and LPA did not observe any unqualified adults are providing care and supervision to the children in care.

Regarding the allegation of “Staff left daycare children unattended”

During the staff interview, 5 out of 5 staff denied the allegation of “Staff left daycare children unattended” and stated that they always provide 100 percent visual supervision to children in care. They all stated that they never observed any staff left any children unattended.

Regarding the incident that occurred on 09/18/2025, S1 stated that when S1 left classroom #3, S6 was responsible to supervise C1 and another child; When S1 came back, S1 observed S6 cried and told S1 that C1 was exited the classroom #3 and ran into parking lot; but S6 ran after C1 and caught C1 and brought him back to the classroom.

S1 stated that S6 also asked P6 to supervise the other child while S6 ran after C1 and S6 did not lose visual of C1. The facility director also stated that this is the first time C1 ran out of the classroom, and C1 doesn't have a pattern of running away. Per director, after the incident, the facility notified C1’s parents about the incident on 09/19/2025 and spoke with all staff regarding supervision policy.

During the parent interview, all 6 interviewed parents did not divulge any information pertaining to the allegations or express any concerns regarding the care of the children.

Based on LPA’s observations, interviews, and records review, the preponderance evidence of (1) Unqualified adults are providing care and supervision to day care children and (2) Staff left daycare children unattended has not been met. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated.

Exit interview was conducted and report was reviewed with the facility representative Wendolin Hernandez.

Notice of Site Visit was posted during the visit. The facility representative was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.

Appeal Rights were explained. The facility representative was provided with a copy of the appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
