32 | On 10/21/25 the Orange County Child Care Office received a complaint alleging (1) Staff are operating out of ratio (2) Staff denied a daycare child access to food. Reporting Party (RP) stated the following: On September 9th Staff#8 (S8) from classroom blue room 110 had 14-15 kids on their own. On this day, there was a sports enrichment program that many classes were part of 102, 103, 106, 107, 108, 109, and 110. The person who was running the program Adult#1 (A1) went outside to call classroom blue room 110 in and S8 walked inside with 14-16 kids on their own with A1. S8 also told Child#6 (C6) that they are not allowed to eat their own snack from home and must only eat the school snack. RP also expressed staff member are unkind to the children.
During the investigation, LPA toured the facility and conducted interviews with 10 staff members, 5 children and 3 parents. LPA also reviewed A1’s file.
Regarding allegation: Staff are operating out of ratio
During staff interviews, Staff#9 (S9) stated the following: On Sept 9th we had a demo class for playball. When A1 was done with classroom Teal 109, A1 went outside to get class, Blue 110. The children ran over to the door and began walking in with the class. S9 yelled out to S8, since S9 was attending to a child, A1 was not allowed to take the children. That day they had 16 children and 15 children walked in with A1 and S8. One child stayed outside with S9 since child had sand all over. 1-2 minutes passed before the child and S9 made it to the demo class. Statt#10 (S10) stated the following: Soccer shots come on site once a week, on Wednesdays. Play ball comes on Friday’s. The program is going to end in mid-November. There are about 5 or 7 children. Those 5 or 7 children will be taken out of their classroom. One of our qualified staff members will stay with the children. A1 is a qualified staff member and has a file in place. On 10/29/2025, S10 sent A1’s file via email to the LPA. LPA reviewed the file and A1 has met all regulation requirements to be a qualified staff member.
Regarding allegation: Staff denied a daycare child access to food
During staff interviews, S8 stated the following: Children are allowed to bring snacks as long as there are no allergies. The facility also offers their own snack to the children. At first, S8 told the children that they couldn’t bring their own snacks from home, but then S9 reminded S8 that children can bring their own snack from home so S8 told the children that they can bring snacks from home. S8 provides school snacks to all children. S8 has not denied children access to food. Children can eat their own snack from home or snacks from school. 5 out 5 children stated that they are allowed to bring and eat their own snack from home at school.
