32 | Regarding allegation (1) Staff denied day care child’s access to the bathroom during LPA’s observations on teacher-child interactions, staff were attentive to the children’s needs. All seven (7) interviewed staff provided consistent statements about following facility’s toileting procedures. Seven (7) out of seven (7) staff interviewed denied ever restricting a child access to the restroom or denied ever witnessing another staff member restrict a child access to the use the restroom. Six (6) out of six (6) interviewed children provided consistent statements about having access to use the restroom whenever they needed. Six (6) out of six (6) children provided consistent statements about staff advising them to wait for short periods of time to use the restroom. LPA examined Staff Handbook, Admission Agreement (which outlines: Title 22, Department of Social Services has the right to interview the child, Health, Recovery and Medication Agreement, Tuition Agreement, etc).
The Orange County Regional Child Care Licensing Office has investigated the complaint alleging that staff denied day care child’s access to the bathroom. Based on the information gathered from LPA’s interviews and record reviews, although the allegation may have happened or is valid, there was not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

A notice of site visit was given and must remain posted for 30 days.
