Licensing Program Analyst (LPA), Mahnaz (Nancy) Malek conducted an onsite case management inspection of this facility for the purpose of investigating an incident that the facility self reported to our office on 5/14/2026. LPA met with director, Savannah Garcia. Census was taken. There were 14 napping preschool children with one staff in one classroom. A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. According to the self reported incident, on 5/11/2026, S1 and S2 were supervising children on the playground. S1 escorted five children to the restroom. Upon returning to the playground, S2 conducted another count and identified only four children. S2 asked S1 about the fifth child. A1 arrived at the playground with C1 whom A1 found the missing child outside the restroom inside the building. The report stated C1 was alone for approximately 10–15 seconds.
Today LPA interviewed the staff who were involved in the above reported incident or had information about it. Staff # 1 (S1), (S2), and (S3). S1 stated S1 was with 9 to 10 children on the playground on 5/11/2026 around 4:30 pm. S2 arrived to give S1 a ten minutes break. Five children needed to use the restroom. S1 decided to take 5 children to restroom, then takes their 10 minutes break. S1 stated they walked outside the Discovery Playground out of the gate, passing the preschool playground, entering the classroom leading to restroom. S1 confirmed that they had 5 children. S1 admitted that when S1 brought the children back walking out of the restroom, walking through the preschool playground forgot to count children. S1 thought five children were following S1 not knowing Child # 1 (C1) did not follow S1 out of the classroom door to the playground. S1 believes C1 was left unattended for approximately 2 minutes. S2 stated S2 arrived on the Discovery Playground to give S1 a ten minutes break. S1 took 5 children with them to the restroom before Continued on page 2

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

going on ten minutes break. S2 stated S2 observed S1 is returning to the Discovery Playground with only 4 children. S2 questioned S1 about the 5th child. At this time S1 realizes that one child was left unattended. At this time Adult # 1(A1) signed out their child and left the playground exiting thought the classroom door, opens the classroom door and notifies the staff that C1 was left unattended in the classroom by the door.
S3 stated S3 was on the adjacent playground observing the incident. S3 confirmed that S3 observed 5 children left the Discovery Playground for restroom. S3 observed S2 asked S1 about the 5th child when S1 was on the way returning to the playground. LPA also reviewed the Internal Kindercare Child Supervision Record (CSR) for the date of the incident. LPA observed that there is no record of time for S1 taking children to the restroom. According to CSR, there were 11 children when S2 joined S1 on the Discovery Playground. Record shows S2 signed in at 4:24 pm to join S1. A1 who informed the staff that C1 was at the door inside the classroom signed out their child at 4:30 pm. Therefore, there in no accurate calculation of time that how many minutes C1 had been left unattended. Based on the self reported incident, and three staffs' interviews today, reviewing Internal Kindercare Child Supervision Record (CSR) dated 5/11/2026, it was determined that the facility was in violation of lack of supervision leaving C1 unattended. S1 believes C1 was left unattended for 2 minutes. According to the documents, the whole incident from start to end took approximately 6 minutes. The following deficiency 'Responsibility of Care and Supervision" was cited of the California Code of Regulations, Section 101229(a)(1) Title 22, Division 12 on today's investigation regarding the incident of leaving C1 unattended. Please see LIC 809D on next page for details of the deficiency. The director, Savannah Garcia was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. The “Notice of Site Visit” must be posted on or adjacent to the door. Failure to post will result in Civil Penalties of $100.00. LPA Malek informed the director, Savannah Garcia that this report dated 5/18/2026 documents type A citation shall be posted for 30 consecutive days as there is immediate risks to the health, safety, or personal rights of children in care. Also, LPA Malek informed the director, Savannah Garcia to provide a copy of this licensing report dated 5/18/2026 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. The director, Savannah Garcia was provided with a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. The exit interview was conducted with the director, Savannah Garcia. End of report.

observation. The above requirement was not met as evidenced by: a self reported incident interviewing 3 staff, and admitting of S1 leaving C1 unattended in transitioning from the playground to restroom for 2 minutes. This is an immediate risk to the health and safety of children in care.
