On 7/10/2025, Licensing Program Analysts (LPAs) D. Valdez Santana and J. Carreiro conducted an unannounced complaint visit to deliver the complaint findings. LPA met with staff at approximately 8:45am. LPAs stated the purpose of the visit. LPAs toured the facility, and a census was taken. LPA observed Room #46 with 9 preschool-age children and 3 staff and Room #45 the half-day program is out for the summer. At approximately 9:30am Director Keely Orlando arrived to the facility to meet with LPAs.

A review of the Facility Personnel Report Summary conducted on today’s date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 4/28/2025, the Orange County Child Care Office received a complaint alleging: (1) Facility is operating out of ratio, (2) Facility staff left children unattended, (3) Facility staff did not ensure children were provided with adequate time to eat/nap. Page 1 of 4

During the investigation, LPA Valdez Santana interviewed 5 staff members, 2 former staff members, 3 children, and 5 parents . LPA took photos of the classroom schedules. LPA also obtained a copy of the Children’s Roster and Personnel Report.

Regarding the allegation “Facility is operating out of ratio,” five (5) out of five (5) staff stated the ratio is 1 staff to 8 children and denied violating ever being out of ratio. Three (3) out of three (3) children interviewed did not make any disclosures. Five (5) out of five (5) interviewed parents stated they had no concerns about the facility and did not disclose any information related to the allegation. Additionally, LPAs obtained children’s sign/out records and staff Absentee Reports for December 2024, February 2025, and April 2025. LPAs reviewed the documentation and did not observe that the facility was operating out of ratio. Based on observation, record reviews, and interviews there is not a preponderance of evidence to prove that Facility is operating out of ratio.

Regarding the allegation, “Facility staff left children unattended,” Five (5) out of five (5) staff denied children have ever been left unattended. Staff #1 (S1) stated, staff do not walk out leaving staff out of ratio, staff help each other out if needed. Staff #2 (S2) denied ever walking out of a classroom and leaving children unattended. Staff #3 (S3) stated Staff are always walking around and constantly watching the children and maintain ratios; staff count the children during every transition. Staff are constantly communicating with each other. Staff #4 (S4) stated, staff count various times throughout the day, staff also do name-to-face document it on the board and change the number throughout the course of the day. Staff #5 (S5) stated, staff have to supervise the children and keep their eyes on them, watch the children in the bathroom, never leave children alone, make sure the environment is safe. Staff walk the children to the gate and if staff can’t, staff ask the parents to come get the children. Staff always make sure to maintain ratios. Three (3) out of three (3) children denied ever being left alone by staff. Five (5) out of five (5) interviewed parents stated they had no concerns about the facility and did not disclose any information related to the allegation. Based on LPA's interviews and observations, there is not a preponderance of evidence to prove that Facility staff left children unattended.

Regarding the allegation, “Facility staff did not ensure children were provided with adequate time to eat/nap.” S1 stated lunch time is from 11:15am-12pm and naptime is from 12pm-2pm. If a child is not done eating by 12pm, staff always ask them, if they are done, staff don’t force the children to throw away their food. Some children are not fast eaters, so staff give them extra time. Page 2 of 4

If children are not awake by the time naptime is over, staff turn on the lights at 2pm, if a child is still sleeping, staff do not wake them up roughly, staff give them time to wake up. S2 stated if a child is not done eating by 12pm, staff give them a few more minutes. Staff do not make the children throw away their food if they are not done eating but if children are playing then staff do tell them to clean up. S2 stated the procedures for naptime are staff turn the lights on, staff don’t wake the children up, staff let them wake up on their own. If children are still sleeping by the time naptime is over, staff let them sleep. S3 stated the procedures for lunch time are staff will set up lunch, everyone comes in and the children wash their hands and eat, staff encourage the children to try to open their packages, or staff will help and encourage the children to eat. If children are not done eating by 12pm, staff will give them a little more time, like 5 more minutes. The lights are turned off and S3 will turn on the desk light so that there is some light while children are still eating. S3 will have a staff member sit with the child while they finish eating. S4 stated if a child is not done eating by 12pm, staff will sit and wait for the child. Once the children are finished, teachers check in with the child. S4 denied staff are told to throw away children’s food if they are not done. Naptime is roughly from 12pm-2pm, if children are not awake by the time naptime is over, staff let the children wake up at their own time, staff don’t wake them up. The lights get turned on, but children are given time to wake up. S5 stated staff get lunch on the table around 10:30am-10:35am, if a child is not done eating by 11am, the children always finish their lunch. The slow eaters sit first because they take more time. S5’s class is a part-day program, so they don’t take a nap. Three (3) out of three (3) children interviewed did not make disclosures about the above allegation. Five (5) out of five (5) interviewed parents stated they had no concerns about the facility and did not disclose any information related to the allegation.

During the course of the investigation LPA observed lunch time, naptime and dismissal time. Children seemed to have adequate time to eat and nap. Staff escorted the children out to authorized representatives. Based on LPA's interviews and observations, there is not a preponderance of evidence to prove that Facility staff did not ensure children were provided with adequate time to eat/nap.

Based on the information gathered from LPAs’ interviews, observation, and records reviewed, the preponderance of the evidence has not been met. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations of Facility is operating out of ratio, Facility staff left children unattended, Facility staff did not ensure children were provided with adequate time to eat/nap, therefore, the allegations are UNSUBSTANTIATED.

Exit interview was conducted, and report was reviewed and discussed with facility representative. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days.
