Licensing Program Analyst (LPA) Mahnaz (Nancy) Malek conducted a follow up investigation regarding the above allegations. This is a follow up for the visit conducted on 3/25/2024. LPA met with director, Holly Shobe. LPA observed 6 infants with 2 staff in the infant room and 7 toddlers with 2 staff in Toddler Room B. No children observed in Toddler A Room.
A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 3/22/2024 Orange County Childcare Office received a complaint report regarding the above allegations. The facility also self reported the above allegations when they found out about it. According to the complaint report, it was observed staff # 1 has shaken and screamed at child # 1 for climbing on

the table which made the child cry. The report stated staff # 2 observed staff # 1 tripped multiple kids on purpose whenever staff # 1 would become angry or agitated with children. Report stated staff # 2 has admitted that staff # 1 shook and yelled at child # 2 for biting. Report stated it was observed staff # 1 come up behind the children, grab them, shake them, and yell in their face whenever children did something wrong.

On 3/25/2024 LPA conducted a visit and interviewed 8 staff. On 3/26/2024 LPA interviewed staff # 1 regarding the above allegations. Ten parents were also contacted.

Total of 9 staff who work in the infant/toddler program were interviewed regarding the above allegations. Children were not interviewed due to their age being young and not being qualified. Total of 10 parents of the infant/toddler program were also contacted of whom 2 parents responded with positive feedback. LPA interviewed staff # 1 regarding the above allegations. Staff # 1 denied all the allegations and stated they have never got frustrated with any children to do anything out of anger to hurt children. I love them. They love me. I talk to the child and I ask them if I can do anything for them. If they are running around, I tell them I don't want you to fall. I hold their hands. I have never shaken or screamed at any child. I might have raised my voice to stop children of doing something dangerous. I have never intentionally tripped children. LPA interviewed staff # 2 regarding the above allegations. Staff # 2 stated they are a joyful group. They have not seen any aggressive behavior from anybody. They have not seen anybody to be aggressive towards any children. They have not seen any staff with anger temper to trip children purposely. They have not seen any staff to scream or shake or trip any children.

LPA interviewed the other seven staff who have worked with staff # 1 in the infant/toddler program. They all denied observing any staff mistreating children. They did not acknowledge observing staff trip children or scream at children or shake them, or grab them. They stated they might have raised their tone of voice to stop a toddler of doing something dangerous such as saying 'Stop" but never screamed at any child.

Based on the interviews conducted with a total of 9 staff working in infant/toddler program, and contact of 10 parents of whom 2 responded with positive feedback, there is not enough proof or evidence to support the

above allegations occurred or did not occur. This agency has investigated the complaint alleging "Staff mishandled the day-care children while in care", Staff tripped the day-care children while in care", "Staff yelled at the day-care children while in care", and "Staff behavior poses as a risk to the day-care children" ; although the allegations may have happened or are valid, there is not a preponderance of evidence to prove, the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.

Notice of Site Visit was posted. The notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The director, Holly Shobe was provided a copy of their appeal right (LIC 9058 1/16) and their signature on this form acknowledges receipt of these rights.
No deficiency cited on this inspection date.
