32 | On 8/31/2023 the Orange County Child Care Office received a complaint alleging children are commingling, staff do not provide direct visual observation of infant at all times, and staff allowed an infant to eat a snack off the floor. Reporting Party (RP) stated in the morning RP witness infants on the floor on top of a U-shaped pillow surrounded by older children. RP stated that RP witnessed a child crying and no staff checking on the crying child and there was a distance between the child crying and the staff. RP does not know how long the child was crying. RP also stated RP witnessed a child eating a cookie on the floor and RP believes the child was eating a cookie on the floor because there were not enough seats on the table.
LPA Nunez interviewed 14 staff members. 14 out of 14 staff members stated they have never mixed preschool children with toddlers or infant children. 7 out of 14 staff members stated infants of 12 months or under when they arrived early morning, they go to room B where there are 2 staff members and once they have met ratio or have 12 children (the ratio for 2 staff are 8 infants), they either go to their classrooms or have a 3rd staff member come into the classroom. 5 staff members that work with children 12 months and under stated that when a child is crying, they go to the child and see if the child needs a change of diaper, a bottle, or is tired. 7 staff members stated during infant care they are near the infants and infants are never left alone. 14 staff members stated they have not witnessed any infants eat on the floor. On 10/3/2023 around 11:05am, LPA Nunez observed rooms Infant B and Infant A. In room Infant B there were 3 infants, and they were eating lunch. Each infant was in a highchair. LPA noticed an extra highchair in the Infant B classroom. When LPA entered room Infant A there were 3 infants eating lunch, 1 infant on the activity mat, and 2 infants sleeping. There were no extra highchairs in room Infant A. Staff#7 and Staff# 8 disclosed that rooms Infant A and Infant B share highchairs. There is a door in the middle of both classrooms that connects to the classrooms and through the door they share the highchairs as needed. 12 out 14 teachers stated there are enough seats for infants to eat their meal/snack on the table.
On 10/30/2023 when LPA arrived there were 8 infants under 12 months in the Infant B room. 6 infants were on the mats and staff were on the floor interacting with the infants and 2 infants were sleeping on the cribs. LPA did not observe any children commingling in any of the infant classrooms.
LPA Nunez was not able to interview the infants due to the infants being non-verbal.
