Licensing Program Analyst (LPA), Mahnaz (Nancy) Malek conducted an onsite case management inspection due to an incident that the facility self reported to our office on 11/15/2024. LPA met with director, Alex Ramstorf. LPA took census. There were a total of 65 napping preschool children with 5 staff. There were 12 napping children with one staff, 20 napping children with one staff, 14 napping children with one staff, 10 napping children with one staff, and 9 napping children with one staff in 5 different rooms. According to the self incident report, 2 year old child was left unattended in the classroom for few minutes during transitioning to another classroom.
A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
Today, LPA interviewed the director, Staff # 1 (S1), Staff # 2 (S2), and Staff # 3 (S3) who had information regarding the incident.
During interview with staff, Staff # 1 (S1) stated S1 was transitioning children from one room to the transitioning room few feet away from each other so children nap in the transitioning room with the other group of children. S1 admitted S1 conducted name to face with children when they were leaving the room for the transitioning room. However, S1 admitted S1 did not properly check the name to face when they arrived in the transitioning room. S1 did not realize Child # 1 (C1) was not in the group. S1 estimates C1 was left unattended in the first classroom for 3 minutes. S2 notified S1 and S3 of C1's presence in the hallway between the two rooms.
S2 stated S2 was in the hallway when S2 observed C1 opened the door of the original room and came out. S2 stated S2 heard S1 was calling children's names in the hallway before going inside the transitioning room.
S3 stated S3 was already in the transitioning room when S1's children arrived for nap time. S3 heard

S1 calling children's names conducting name to face but not sure if all the children were marked off correctly on the log. S3 estimates C1 was left unattended for few minutes.
LPA reviewed the internal Kindercare log for Children's Supervision Record (CSR) dated 11/14/2024. LPA observed the time of transitioning was recorded 11:47 am. S2 stated they saw C1 coming out of the classroom around 11:50 am. So it is not determined the exact time but it is estimated C1 was left unattended for 3 minutes.

Based on the staff interviews, S1's admission, and reviewing Child Supervision Record (CSR) for the day of 11/14/2024, it is estimated C1 was left unattended for 3 minutes in the classroom and C1 was not transitioned to the transitioning classroom during transitioning time. California Code of Regulations, Title 22, Division, Chapter 12, is being cited on the attached LIC 9099D for the deficiency sections 101229(a)(1) Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs (1) No child(ren) shall be left without the supervision of a teacher at any time. Supervision shall include visual observation. This is a repeat violation of the same section of 101229(a)(1) that was issued on 6/12/2024. An immediate civil penalty of 250.00 for is assessed for 11/18/2024 and 100.00 per day until is corrected.

Director, Alex Ramstorf was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. The “Notice of Site Visit” must be posted on or adjacent to the door. Failure to post will result in Civil Penalties of $100.00. LPA Malek informed the director, Alex Ramstorf that this report dated 11/18/2024 documents type A citation shall be posted for 30 consecutive days as there is immediate risks to the health, safety, or personal rights of children in care. Also, LPA Malek informed the director, Alex Ramstorf to provide a copy of this licensing report dated 11/18/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report.
A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. Director, Alex Ramstorf was provided with a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. The exit interview was conducted with director, Alex Ramstorf.
