Licensing Program Analyst (LPA) Cynthia Sun conducted an onsite investigation for the purpose of delivering the finding for the complaint which started on 03/12/2025. LPA met with Director, Alex Ramstorf who guided LPA for a facility tour. There was a total of 48 preschool children and 6 staff present at the facility. Children were gathered playing and preparing for breakfast with staff supervising them.

Staff records on this date 5/09/25 indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 3/06/2025 Orange County Regional Office received a complaint alleging facility staff are not assisting children with hygiene needs, staff do not keep facility clean, staff do not keep the facility free of pests, staff handles children in a rough manner, and staff yell at children in care.

Reporting Party (RP) stated a child was constantly coming home dirty with dirt and boogers ran down on the face; This child constantly getting sick; Facility has mice and roaches; teachers are mean and yell at the children; teachers also grabbed the children’s arm hard, and it hurt. The child was not able to identify the teachers’ names, but stated all teachers are mean.

During the investigation, LPA interviewed 5 staff members, 5 parents, 5 children, and reviewed records which included Kindercare Learning Center Roster, Family Handbook, Cleaning Classroom Checklist, Common Area Cleaning Checklist and Truly Nolan Branch 712 Service Pesticide Service Invoice.

Regarding allegation: Staff are not assisting children with hygiene needs:

During the staff interviews, 5 out of 5 staff interviewed stated they help children with hygiene when needed. Staff #3 (S3) stated, “yes the children need help to blow nose, I will guide them. If they go potty, I guide them. If they need help, I will wear a glove and I will help them. Basically, if the children need help, I will assist them.” Staff #4 (S4) stated “When I step into the classroom and I see children have boogers, I tend to help the children clean themselves up”.

During the children interviews, 5 out of 5 children interviewed stated, the teacher help them when they go to the bathroom, or when they need help to wipe noses. Child #5 (C5) stated “The teachers help us wash our hands or they help us get tissue for our nose”.

During LPA visit (3/14/25) LPA observed staff helping children by cleaning their noses and guiding children though hand washing process.

Regarding allegation: Staff do not keep facility clean:

During the staff interviews, 5 out of 5 staff interviewed stated they help to keep facility clean. Staff #1(S1) stated “I wipe the table after meals, snacks and spray cots, and I clean during nap and after nap. I mop after nap”. Staff #3 (S3) stated “after meals we clean tables. After art and crafts we clean, and we clean the restrooms everyday”.

Staff #4 (S4) stated “The teachers are responsible for maintaining the classrooms clean and we have a house keeper that comes at night time. She does the floors and the restrooms and so forth”. Staff #5 (S5) stated, “we have a cleaning list to follow. I sweep floors and wipe tables. We all help clean bathrooms, and if we are in infant room we clean highchairs”. Facility provided LPA with samples of Classroom Cleaning Checklist and Common Area Cleaning Checklist which are completed daily and weekly. LPA visited facility on 3/12/25 and 3/14/25 and facility was free of clutter, trash, bugs and un-necessary materials.

Regarding allegation: Staff do not keep facility free of pests:

During the staff interviews, 5 out of 5 staff stated they have not seen any pests, bugs, roaches or mice in facility. Staff#1 (S1) stated “No, once in a while a fly comes into the classroom”. Director provided a copy of most recent Truly Nolan Branch 712 Service Pesticide Service Invoice date 3/8/25. Facility Director stated Truly Nolan services facility once a month. Facility director stated, “We do not have mice or pests in facility.

5 out of 5 children interviewed stated they have not seen any mice, roaches or other pests in facility.

During LPA’s visits 3/12/25 and 3/14/25 no bugs, pests, rats or flies were observed.

Regarding allegation: Staff handles children in a rough manner:

During the staff interviews, 5 out of 5 staff stated they have not seen children being grabbed. S1 stated “No, when I take children to the restroom, I usually stand outside, where I can see them and use my words to guide them”.

5 out of 5 children interviewed did not divulge any information pertaining to the allegation. During LPA’s visits 3/12/25 and 3/14/25, LPA did not observe teachers handling children inappropriately.

Regarding allegation: Staff yell at children:

During the staff interviews, 5 out of 5 staff stated they have not heard staff yelling at children. S1 stated “No, I have just heard staff just re-directing children”.

During LPA visits 3/12/25 and 3/14/25, LPA did not observe staff yelling at children.

LPA conducted interviews with 5 parent and 5 out of 5 parents stated they are satisfied with facility.

Based on LPAs observations, interviews which were conducted, and records reviewed, the preponderance of evidence of facility staff are not assisting children with hygiene needs, staff do not keep facility clean, staff do not keep the facility free of pests, staff handles children in a rough manner, and staff yell at children in care has not been met. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.

Exit interview conducted and report was reviewed with Director. Notice of Site Visit was posted and must remain posted for 30 days. Failure to comply with the posting requirements shall result in an immediate civil penalty of $100.

Appeal Rights were explained. The Director was provided with a copy of the appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
