Licensing Program Analyst (LPA), Silva conducted an Annual/Random visit assisted by licensee Melba Findling. The licensee had four children in care, including two infants. The licensee was operating within the licensed capacity. The home day care hours are 7:30 AM - 5:30 PM, Monday through Friday. A review of the Facility Personnel Report Summary indicates all facility residents, staff, or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

During the inspection, the LPA toured the home day care areas and areas accessible to day care children. Off limits areas are made inaccessible by means of baby safety locks or safety gates. The day care area consists of a dining room, a living room, the family room, and one bathroom. The family room is the main care area.

The facility has two electric fireplaces in the day care area that are barricaded with metal or glass screens. The home is equipped with a carbon monoxide detector, and a smoke detector and fire extinguisher that meet statutory and State Fire Marshall standards. Last fire/disaster drill documented on 11/26/24. Licensee was reminded to conduct and document drills at least once every six months. Detergents, cleaning compounds, medicines, and other items which could pose a danger if readily available to children were stored inaccessible to children. Per the licensee, there are no firearms or other dangerous weapons in the home, and none were observed during today's inspections. LPA verified there is a working telephone service (cellular service).

The licensee stated the front patio is the outdoor play area. The LPA observed the outdoor play area was in good repair an unfenced. The licensee was reminded to always supervise children when in the outdoor play area. There is a spa in the home. The spa has cover that can support the weight of an adult.

The LPA reviewed children’s records for children present. The emergency information card (LIC 700) contains all the information required. Each file also contained Immunization records, Affidavit Regarding Liability Insurance (LIC282), Consent for Emergency Medical Treatment (LIC627), and Notification of Parent’s Rights (LIC995A). The licensee stated she has not documented the 15-minute infant safe sleep checks; a citation was issued (See LIC809).

The licensee’s has a valid mandated reporter certificate. The licensee’s pediatric CPR/First Aid certification expired in 2023; a citation was issued along with a plan of correction (see LIC809D).

Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a family childcare home if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for licensee reviewed and within compliance. Beginning March 31, 2018, H&S Code 1596.8662 requires all licensed providers and employees to complete mandated reporting training, and to renew the training every two years.

The licensee understands she must be present in the facility and must ensure children in care are always supervised. Children are not to be left alone in parked vehicles. When the licensee is temporarily absent from the facility, arrangements must be made for a qualified substitute adult to care and supervise children while absent. The substitute adult must have the required criminal record, child abuse index clearances, immunizations, Pediatric CPR/First Aid, and mandated reporter training.

CCLD website www.ccld.ca.gov was provided to licensee to access regulations, updates, and licensing forms. Licensee was advised to register through childcareadvocatesprogram@dss.ca.gov in order to receive quarterly updates. Licensee was advised of their responsibility to review the Provider Information Notices (PIN) found on the CCLD website. A copy of the California Department of Social Services Lead Information Brochure was explained and provided to the licensee.

LPA discussed the safe sleep regulations with licensee [or facility representative] and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. The licensee was reminded the car seats shall not be used for sleeping. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee [or facility representative] was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

In the areas that were evaluated, deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. The following citations were issued: 102425(j)(2) Infant Safe Sleep and 102416(c) Personnel Requirements

Exit interview conducted and report was reviewed with the licensee Melba Findling. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Appeal Rights were explained. The Licensee was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
