In attendance was Licensing Program Manager (LPM) Rina Lopez, Licensing Program Analysts (LPA's) Patricia Rivas, Dean Thompson and Giselle Lucero along with Licensee Maria Aldana. This informal conference and report dated 2/24/2023 was translated in Spanish by LPM Rina Lopez and LPA Patricia Rivas. The purpose of the informal meeting was to discuss the following items: 102416.5(b)(1) Staffing Ratio and Capacity Type ‘A’ deficiencies: (b) For a Small Family Child Care Home, the maximum number of children for whom care may be provided at any one time, including children under age 10 who reside at the licensee's home, shall be one of the following: (1) Four infants; or On 12/8/2022 Upon arrival at 9:25 AM LPA observed assistant caring for eight (8) children. Out of the eight (8) children, five (5) were infants which poses an immediate health, safety or personal rights risk to persons in care. Licensee stated she is no longer taking drop ins and will adhere to the regulations. On 6/12/2015 Licensee was cited a Type A citation for 102416.5(a) Staffing Ratio and Capacity. During the visit, there were 6 day-care children present, 5 of whom were infants. On 5/8/2019 Licensee was cited a Type A citation for 102416.5 Staffing Ratio and Capacity. Licensee was caring for ten day care children, five of which were under the age of two years. Based on observation, record reviews, and interview, the licensee failed to ensure to keep the maximum number of four infant in care at one time. continued on page 2

102423(a)(4) Personal Rights
Type ‘A’ deficiencies: (a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (4) To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature, including, but not limited to: interference with eating, sleeping or toileting; or withholding shelter, clothing, medication or aids to physical functioning.

On 12/8/2022 at 11:26 AM, LPA observed assistant (S1) starting to change childrens diaper on the changing table located inside the living room area. LPA observed assistant change five childrens diapers. Out of the five diapers changed, three were soiled. LPA also observed assisant using the same gloves in between diaper changes and not sanitizing the changing mat after each child which poses an immediate health, safety or personal rights risk to persons in care.

102425(j)(5) Infant Safe Sleep
Type ‘B’ deficiencies: The provider shall supervise infants while they are sleeping and adhere to the following requirements: If the infant is sleeping in a separate room from where the provider is stationed, the door to the room the infant is sleeping in shall remain open at all times.

On 12/8/2022, While touring the home, LPA observed four (4) infants inside a bedroom with the door closed placed inside crib which poses/posed a potential health, safety or personal rights risk to persons in care.

Licensee denied having door closed. Licensee stated she understands and will have the door open.

102425(c) Infant Safe Sleep
Type ‘B’ deficiencies: An Individual Infant Sleeping Plan [LIC 9227 (3/20)] shall be completed for each infant up to 12 months of age the provider has in care and included in the infant's file at the facility.

On 12/8/2022, during children file review, licensee was unable to provide LIC 9227 Individual Infant Sleeping plan form for infants in care which poses/posed a potential health, safety or personal rights risk to persons in care.

102425(j)(2)(D) Infant Safe Sleep
Type ‘B’ deficiencies: Documentation shall be maintained in the infant’s file and be available to the Department for review.

On 12/8/2022, licensee was unable to provide documentation of an infant safe sleep log showing infants are being checked every 15 minutes during nap time which poses/posed a potential health, safety or personal rights risk to persons in care.

Licensee has not submitted an infant safe sleep log to clear the citation. Licensee stated she has begun using 15 minutes safe sleep form and the form is posted near children.

102421(b) Child's Records
Type ‘B’ deficiencies: (b) The licensee shall maintain, in each child's record, a copy of the emergency information card as required
in Section 102417(g)(7)

On 12/8/2022, during children file reviews, LPA observed 2 out of 8 children present did not have a file which poses/posed a potential health, safety or personal rights risk to persons in care.

Licensee stated the two children with missing files were 2 of her sons of friend that couldn't be taken to day care and that they were drop ins which is why she didn't have a file. Licensee stated she will have file for every child .

On 12/8/2022, Assistant present did not have a file available for review which poses/posed a potential health, safety or personal rights risk to persons in care.

Licensee stated her assistant and husband didn't have a file. Licensee stated she didnt think the assistant and husband didnt need a file since they live at the home. Licensee stated she will have a file present for both assistant and husband.

102419(b) Admission Procedures and Authorized Representatives Rights
Type ‘B’ deficiencies: (b) The licensee shall post the PUB 394 (8/02), Family Child Care Home Notification of Parents’ Rights Poster in a prominent, publicly accessible area in the family child care home at all times children are in care.

12/8/2022, while touring the home, LPA observed licensee did not have PUB 394 Notification of Parent Rights posted which poses/posed a potential health, safety or personal rights risk to persons in care.

Licensee stated PUB394 was there at the facility and understands she has to have it posted.

1596.8662(b)(1) Administration of Child Day Care Licensing
Type ‘B’ deficiencies: (1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.

On 12/8/2022, Licensee was unable to provide LPA with a copy of her mandated reporter certification which poses/posed a potential health, safety or personal rights risk to persons in care.

Licensee stated assistant is almost finished with the mandated reporter certification training and husband has not done his training as of yet since the husband was just told about the mandated reporter training.

LPM informed licensee the citations had a POC due date and its been over the date for which assistant needed to comply. LPM informed of importance of complying with POC due dates and civil penalties when not meeting POC due dates

102417(d)(1)Operation of A Family Child Care Home
Type ‘B’ deficiencies: (d) The home shall provide safe toys, play equipment and materials. (1) Fixtures, furniture, and equipment that have been banned or recalled by the United States Consumer Product Safety Commission shall not be used for children in care or accessible to children in care.

On 12/8/2022, LPA observed a saucer chair inside the children's play room which poses/posed a potential health, safety or personal rights risk to persons in care.

Licensee stated a parent brought the chairs to the facility and was told not to bring them. Licensee stated the saucers have been removed and has posted a paper stating items not needed and will not be accepted.

102417(g)(9)(A)1 Operation of A Family Child Care Home
Type ‘B’ deficiencies: (g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (9) Each family child care home shall have a written disaster plan of action prepared on a form approved by the Department. All children, age and ability permitting, and the provider, the assistant provider, and other members of the household, shall be instructed in their duties under the disaster plan. As their age and ability permit, newly enrolled children shall be informed promptly of their duties as required in the plan. (A) Each family child care home shall conduct fire drills and disaster drills at least once every six months. 1. The licensee shall document the drills, including the date and time of each drill. This documentation shall kept at the family child care home.

On 12/8/2022 Licensee was unable to provide LPA with a fire/disaster drill log which poses/posed a potential health, safety or personal rights risk to persons in care.

Licensee stated she has conducted and documented fire/disaster drills.

102417(g)(8) Operation of A Family Child Care Home
Type ‘B’ deficiencies: (8) Each family child care home shall have a current roster of children as specified in Health and Safety Code Section 1596.841

On 12/8/2022, during record review, LPA observed eight (8) children present were not on the roster which poses/posed a potential health, safety or personal rights risk to persons in care.

Licensee stated she has a current roster for children present.

Upon receipt of this report pertaining to a conference conducted by a local Licensing Agency in which issues of non-compliance are discussed, the Licensee must: 1) Provide a copy of this report to the parent/guardian of children currently enrolled by the next business day or immediately upon return. 2) A copy of this report shall also be provided to the parent/guardian of any newly enrolled children for the next 12 months (1 year). 3) Obtain signature and date from the child's parent/guardian on the Acknowledgement of Receipt of Licensing Reports LIC 9224. 4) Keep a record immediately upon receipt of the completed and signed LIC 9224 acknowledging receipt of this report in the child's file.

Licensee was informed to provide a copy of this report and LIC 9224 (Acknowledgement form).

Increased unannounced visits to the facility will be conducted by Community Care Licensing for the next 2 years to monitor compliance. The purpose of these increased inspections to ensure we as the Department are working with the licensees to ensure a return to compliance of regulation and code.

The following was discussed with the Licensee:
1. The licensee was advised that it is her and her assistants responsibility to know and understand the requirements of Title 22 Regulations.
2. The licensee's facility must be in compliance at all times.
3. The licensee will be placed on increased case management visits for two years.
4. The licensee was advised to check the Child Care Licensing web site at www.ccld.ca.gov for quarterly updates, forms and regulations.
5. The licensee was advised to complete TSP.
6. Licensee was advised subsequent citations within the next 12 months will result in civil penalties.

Exit interview conducted with Licensee Maria Aldana, who is in agreement with the above. A copy of this report was provided via email on 2/24/2023.
