Licensing Program Analyst (LPA) Mahnaz (Nancy) Malek conducted a follow up investigation regarding the above allegations. This is a follow-up for the visit conducted on 6/23/2025. LPA met with licensee, Farinaz Shahbazian, and her assistant, Mahsa Asadi. Census was taken. There were a total of 4 children of whom 2 were under 24 months old. The swimming pool in the backyard was inspected which met all the licensing requirements according to new regulation effective 1/1/2025.
A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 06/20/2025, the Orange County Child Care Office received a complaint alleging, 1) staff member handled day care child in a rough manner, 2) staff member forced day care child to nap, 3) staff member spoke inappropriately to day care child, 4) staff member denied day care child food and milk, and 5) staff member yells at day care child.

The reporting Party (RP) reported they were informed of staff’s abusive behavior toward Child # 1 (C1) over the last couple of weeks (unknown dates), It was reported that staff member has been forcing C1 to nap and when C1 cries and protests, staff member tells C1 to “go ahead and cry more”. It was also reported that when C1 was 10 months old, staff member forcefully threw C1 down into the pack and play out of frustration because C1 was not napping. When C1 tosses a spoon or engages in typical toddler behavior, staff member forcefully grabs C1’s hand and yells in C1’s face as a mean of disciplining or stopping C1’s behavior. If C1 asks for additional food e.g., yogurt, or milk, staff member denies C1’s request.

During the course of investigation, LPA interviewed nine (9) adults including adults who are currently working or were working at this facility in the past. LPA also interviewed four older children, of whom one child who was qualified for interview. LPA contacted ten parents of whom 4 responded. LPA gathered additional documentation regarding the above allegations such as video footage during nap time for reported dates of Friday June 13, and June 20, 2025 between 12 to 2 pm.

Regarding Staff member handled day care child in a rough manner, out of 9 interviewed adults, LPA was told that they have never handled a child inappropriately. They love children. Some said they have learned a lot in this facility under the licensee’s training. The staff were trained to lift a child under a child’s arms, and they were taught how to treat children kindly and gently. One said, if a child is throwing tantrum, they are told to give the child some time to become calm. They have not witnessed any rough manner from anybody towards children. They said they have not observed any child to be thrown in the crib. They hold the babies and give them love and care. One staff member stated they think one staff member was mean to children. When asked for more details, they said the staff was cold to children and seemed not to care for them. Some stated they have observed that children are treated nicely. Children were too young to be qualified for interview. However, one child was qualified who did not disclose anything to support the occurrence of this allegation. Out of ten parents who were contacted, four parents responded to LPA with no concerns regarding this allegation. LPA reviewed the video footage taken from the camera during nap time in the napping room (84 clips of video footage, each one approximately one minute or more were reviewed) for the mentioned dated by reporting party of 6/13, and 6/20, 2025 during nap time. No mishandling of children was observed in these clips. LPA heard soft music while 2 adults were present with napping children during nap time. Children were being advised that everyone should take a rest please. “Thank you”.

Regarding Staff member forced day care child to nap, out of 9 interviewed adults, LPA was told, a 3-year-old child (C1) was resisting to nap on some occasions recently, one staff member told children they all needed to nap, while another staff told C1 that C1 did not have to nap. One staff member told all the children were supposed to take a rest. The staff member told the other staff member to stop telling C1 that C1 did not have to take a nap because they would give C1 confused messages. The staff member suggested C1 could get up and play in the other room after 30 minutes of resting. Sometimes C1 would go to sleep, sometimes they would not. Staff stated most children go to sleep easily during nap time. If a child does not go to sleep during rest time, the child can go to the other room to play quietly. Staff did not disclose any other staff member to force children to nap. One staff member stated they have observed the resisting children to nap are separated from napping children so they can play after resting time without any forcing. They would provide them with toys to play quietly. One staff member said children have the opportunity to nap and rest. Most of them go to sleep easily. Some like to be rubbed on the shoulder. If for some reason, they don't nap they will go to the playroom. There are no forcing for children to nap. They need to rest though. Then if they are not tired, they can play. Children present were too young to be qualified for interview. However, one child was qualified who did not disclose anything to support the occurrence of this allegation. Out of ten parents who were contacted, four parents responded to LPA with no concerns regarding this allegation. LPA reviewed the video footage taken from the camera during nap time in the napping room (84 clips of video footage, each one approximately one minute or more were reviewed) for the mentioned dated by reporting party of 6/13, and 6/20, 2025 during nap time. No forcing observed in these video clips. LPA heard soft music while 2 adults were present with napping children during nap time. Children were being advised that everyone should take a rest please. “Thank you”. In one clip, staff member stated to a child who was crying "don't cry please", "We are having quiet time", "That's it". In another clip, staff member takes 2 children to the other room gently because they rested and did not want to nap.

Regarding Staff member spoke inappropriately to day care child, out of 9 interviewed adults, LPA was told that they speak kindly to children. One staff member stated they use words such as "honey", "sweetie" when they call children. One staff member stated staff are kind and sweet and they have not heard staff speak inappropriately to children. Staff stated they watch each other when working together. One staff member stated they heard one staff told a child “Why do you cry?

One stated they have observed one staff is very direct with children while being polite and kind to them. They tell children "No more screaming" "Follow rules", "no biting". They said they talk to children nicely. They hug them if they cry and comfort them. One said they have heard another adult talking to children like "mommy joon do you want this? mommy joon take a rest and we play later. (Mommy joon means mommy sweetie).
Children present were too young to be qualified for interview. However, one child was qualified who did not disclose anything to support the occurrence of this allegation. Out of ten parents who were contacted, four parents responded to LPA with no concerns regarding this allegation. LPA reviewed the video footage taken from the camera during nap time in the napping room (84 clips of video footage, each one approximately one minute or more were reviewed) for the mentioned dated by reporting party of 6/13, and 6/20, 2025 during nap time. No-one spoke inappropriately to children in these video clips. LPA heard soft music while 2 adults were present with napping children during nap time. Children were being advised that everyone should take a rest please. “Thank you”.

Regarding Staff member denied day care child food and milk, out of 9 interviewed adults, LPA was told that they follow the food program agency menu. They said they always prepare enough food for children and enjoy children’s eating. They said they encourage children to finish their food. One said on one occasion, C1 was asking for more frozen yogurt after nap time. Children had got half a portion of a 12 inches long of frozen yogurt. C1 cried for more. Staff member decided to limit the consumption of sugar and that half portion was just additional treat for children and not the main food. C1 and other children had the same amount on that day. One said they offer lots of food, such as meat, turkey, pasta, vegetables, and milk. One said staff are taught to stay with children to finish their food as much as they could. If a child asks for more, their plates would be filled again. Sometimes children say they don't want to eat; staff encourage children to eat. One stated they follow the portion size on the chart from food program. The food is prepared fresh from scratch and children would have enough. There is always back up food in case a child does not like an item on their plate. Children present were too young to be qualified for interview. However, one child was qualified who did not disclose anything to support the occurrence of this allegation. Out of ten parents who were contacted, four parents responded to LPA with no concerns regarding this allegation. LPA was submitted pictures of children eating food.

Regarding Staff member yells at day care child, out of 9 interviewed adults, LPA was told they have never yelled at children. They might be loud and use their loud voice, if there is a dangerous situation for a child. For example, they say “don't do it”. One stated yelling is impossible, maybe using loud voice but not considered yelling. One stated they have heard an adult with loud voice in a dangerous situation telling a child “Stop" but never yelling. One said they heard they always talk to children in sweet language such as "Thank you". One stated they have witnessed one adult yelled at a child telling the child “Sit” in loud voice. One stated sometimes they have to be stern. They have not heard adults yelling at children in an aggressive way. Sometimes children get excited and loud, adults bring to their attention by talking loud to them like “hey everyone” but nothing like yelling at children. Children present were too young to be qualified for interview. However, one child was qualified who did not disclose anything to support the occurrence of this allegation. Out of ten parents who were contacted, four parents responded to LPA with no concerns regarding this allegation. LPA reviewed the video footage taken from the camera during nap time in the napping room (84 clips of video footage, each one approximately one minute were reviewed) for the mentioned dated by reporting party of 6/13, and 6/20, 2025 during nap time. No yelling was heard in these clips. LPA heard soft music while 2 adults were present with napping children during nap time. Children were being advised that everyone should take a rest please. “Thank you”.
Based on interviews with (nine) 9 current and former staff, 4 children (one qualified), contacting ten random parents of whom four responded with no concerns regarding the allegations, and reviewing relevant documents, such as video clips during nap time of the reported dates of 6/13 and 6/20/2025 and pictures, there is not enough evidence and witness to support the occurrence of the above allegations. This agency has investigated the complaint alleging, 1) staff member handled day care child in a rough manner, 2) staff member forced day care child to nap, 3) staff member spoke inappropriately to day care child, 4) staff member denied day care child food and milk, and 5) staff member yells at day care child, “although the allegations may have happened or are valid, there is not a preponderance of evidence to prove, the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.
The Licensee, Farinaz Shahbazian was provided with a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. Notice of Site Visit was posted. The notice of the site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The exit interview was conducted with the licensee, Farinaz Shahbazian.
