THIS IS AN AMENDED REPORT OF THE ORIGINAL COMPLAINT REPORT ISSUED ON 09/18/2025.

Language Services were used for Mandarin translation to conduct investigation with Translator Identification (ID)#38836067. On 09/18/2025, Licensing Program Analyst (LPA) Deschampe conducted an onsite investigation for the purpose of delivering the findings for the above allegations. LPA arrived at the facility at 9:16 AM and was met by licensees and toured the facility at 9:24 AM. There was a total of 6 children and 2 staff present at the facility. A review of staff criminal clearance record on this date 09/18/2025 indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 07/14/2025, Orange County Regional Office (OCRO) received a complaint stating (1) Adult spoke inappropriately towards a daycare child, (2) Licensee did not provide healthful accommodations with food,
(3) An adult's behavior poses as a risk to a daycare child, and (4) Staff did not meet the needs of children in care. During the Reporting Party (RP) interview, RP stated staff spoke to a crying child inappropriately

by asking why the crying child was the only child that cried while the other children did not cry, staff did not follow formula instructions when feeding children, staff bounced Child 1 (C1) roughly on staff leg, and staff took pictures of crying child and did not provide comfort.

On 07/17/2025, LPA Deschampe and Licensing Program Manager (LPM) Tran made an unannounced visit to the facility and interviewed the licensee with the use of Language Services for Mandarin Translation from Translator ID#16421044. Licensee provided LPA with documents pertinent to the investigation including, facility Admission Agreement, Child Care Facility Roster (LIC 9040), and pictures obtained.

Regarding allegation: (1) Adult spoke inappropriately towards a daycare child
During the course of the investigation, LPA interviewed 2 staff members and 4 parents. No children interviews were conducted due to children being non-verbal. LPA also obtained and reviewed screenshots, text messages, and videos from licensee and RP.
On 08/19/2025, LPA reviewed a transcription from Video 1 submitted. The video transcription states, male said: “Ok ok, don’t cry. See, they are not crying. Where do you want to go? O, you are trembling.” The video is of an adult with a crying infant (as defined by the Department, under 24 months of age).
During the staff interview, 2 out of 2 staff stated they will tell children in care to look at other children in care as guidance for development goals such as, not crying and diaper wearing. 2 out of 2 staff stated this is a more natural way to address issues.

Regarding allegation: (2) Licensee did not provide healthful accommodations with food.
During the course of the investigation, LPA interviewed 2 staff members and 4 parents. No children interviews were conducted due to children being non-verbal. LPA also obtained and reviewed screenshots, text messages, and videos from licensee and RP.
During the staff interview, 2 out of 2 staff confirmed formula is given to children but is thrown away within one hour. 2 out of 2 staff have signed and dated a declaration stating they will throw out opened formula within one hour or according to the manufacture instructions.

Regarding allegation: (3) Staff behavior poses a risk to children in care.

During the staff interview, 2 out of 2 staff state when a child in their care is crying, they will comfort the child and tell the child their parent is coming. Staff 2 stated they will not continue with a child if that child

continues to cry past the 3-6 week integration period. LPA received and reviewed videos and pictures of children in care from the facility and the RP.

Video 1: Staff 1 was observed to take pictures of children in care while Child 1 (C1) cried and was not comforted.

Video 2: Staff 1 (S1) is seated and cradling C1 who is falling asleep however, S1 is bouncing S1’s leg and roughly patting the bottom of C1 in a manner that makes C1’s eyes open with every pat on C1’s bottom.

Regarding the allegation (4): Staff did not meet the needs of the children

During the staff interview, 2 out of 2 staff stated they would comfort children by gently patting them and telling them their parents will be coming soon.

In video 1: Staff 1 was observed to take pictures of children in care while Child 1 (C1) cried and S1 did not comfort the child.

LPA called 11 parents for an interview and out of 11 parents, only 4 parents responded to LPA. 4 interviewed parents did not make any disclosure regarding the above allegations.



Based on LPA’s interviews and record review, the preponderance of evidence has not been met. Although the allegations of (1) Adult spoke inappropriately towards a daycare child, (2) Licensee did not provide healthful accommodations with food, (3) An adult's behavior poses as a risk to a daycare child, and (4) Staff did not meet the needs of children in care may have happened or are valid, there was not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.

The exit interview was conducted with the licensees, Wen Liao and Hsin Dai. The Notice of Site Visit was posted during the visit. The licensees were reminded that the Notice of Site Visit must be posted for 30 consecutive days. Appeal Rights were discussed and provided to the licensees and their signature on this form acknowledges receipt of these rights. Licensees must file an appeal, in writing, to the Regional Manager within 15 business days from the date of receiving the penalty assessment or notice of deficiency. First level appeals should be sent to the Regional Manager at the address listed above.
