On 11/01/2024 an Annual Random inspection was conducted at the facility by Licensing Program Analyst (LPA) Anna Chan. LPA met with licensee Pantea Akbari Pazooki. Licensee and husband/assistant Behnam Beygzadeh were caring for 11 children including 2 infants in the childcare area. Licensee was operating within the licensed capacity as specified on license.

A review of the Facility Personnel Report Summary on this date indicates all facility residents, staff, or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Currently there are 3 adults including the licensee and 1 minor child living in the home. Facility Day care hours are 8:00am-6:00pm, Monday through Friday.

During today’s inspection, LPA and licensee toured the inside and outside areas identified in the facility sketch as accessible to childcare children. The home has 2 floors, the second floor is barricaded by a child safety gate. There are 5 bedrooms and 2.5 baths, kitchen, living room, kids inside area, backyard, laundry room and garage. Licensee stated the main day care area is the inside kids area which is on the left past the living room, upon the entrance of the facility. The backyard is used for outdoor play. There is a fireplace in the inside kids’ area barricaded by a toy shelf and made inaccessible to children in care. There is a second fireplace at the living room with a 3 panel metal covering. Off limit areas are made inaccessible by means of baby gates and safety cabinet door latch. Licensee acknowledges that children are never to enter an off-limit area of the home.

There are working carbon monoxide, smoke detector, and fire extinguishers in the home that meet statutory and State Fire Marshall standards. The facility has not conducted an emergency drill since October 2023. Detergents, cleaning compounds, medicines, and other items which could pose a danger if readily available to children were stored inaccessible to children.

Operation of A Family Child Care Home
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use.

Based on observation and inspection, the licensee did not comply with the section cited above, the in-ground pool gate has a key and lock on top; however, the gate is not self-latching and the latch is 16” from the top of the fence which is 10" difference from regulation, which poses an immediate health, safety or personal rights risk to persons in care.

There were no poisons or other items observed which could pose a danger to children or if they were observed, they were locked or inaccessible. Licensee stated there are no firearms and/or other dangerous weapons in the facility and none were observed during today's inspections. The home has age-appropriate toys for the ages served. LPA verified there is a working telephone service (cellular service), licensee was reminded that childcare phone needs to remain the in the childcare at all times.

There are bodies of water on the premises. There is an in-ground pool with mesh fencing. LPA observed and inspected bodies of water, the gate has a key and lock on top; however, the gate is not self-latching and the latch is 16” from the top of the fence which has a 10" difference from the regulated 6". LPA completed bodies of water checklist. LPA provided licensee a copy of Title 22 regulations 102417 Operations of a Family Child Care Home highlighting about bodies of water. LPA also provided licensee a copy of Assembly Bill No. 2866 Pool Safety.

The licensee does have a current roster of children in care. 8 Children’s records for children present during LPA’s inspection were reviewed for a copy of the emergency information card that contains all the information specified by regulation (LIC 700), Immunization records, Affidavit Regarding Liability Insurance (LIC282), Consent for Emergency Medical Treatment (LIC627), Notification of Parent’s Rights (LIC995A). 2 infants does not have current 15-minute sleep log. 1 child does not have immunization records.

The licensee’s Pediatric CPR/First Aid certification expires on 05/2026. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a family childcare home if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for licensee were reviewed and within compliance, and influenza shot. Beginning March 31, 2018, H&S Code 1596.8662 requires all licensed providers and employees to complete mandated reporting training, and to renew the training every two years.

LICENSEE KNOWS FACILITY PLANS TO PROVIDE IMS:

The licensee understands she must be present in the facility and must ensure children in care are always supervised. Children are not to be left alone in parked vehicles. When the licensee is temporarily absent from the facility, arrangements must be made for a qualified substitute adult to care and supervise children while absent. The substitute adult must have the required criminal record, child abuse index clearances, immunizations, Pediatric CPR/First Aid, and mandated reporter training. CCLD website www.cdss.ca.gov/inforesources/community-care-licensing was provided to licensee to access regulations, updates, and licensing forms. Licensee was advised to register through childcareadvocatesprogram@dss.ca.gov in order to receive quarterly updates. Licensee was advised of their responsibility to review the Provider Information Notices (PIN) found on the CCLD website. A copy of the California Department of Social Services Lead Information Brochure was explained and provided to the licensee.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

In the areas that were evaluated, 1 Type A and 3 Type B deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. Civil Penalty assessed.

Deficiencies observed are Physical Plant - Type A: 102417(g)(5)(A) Operation of A Family Child Care Home for bodies of water. Type B: Health and Safety Code 1597.622 (a)(1) General Provisions and Definitions - immunization. Type B: 102425(j)(2)(D)(c) Infant Safe Sleep for sleep log. Type B: 102417 (g)(9)(A) Operation of A Family Child Care Home for disaster drill.

LPA Chan informed licensee, Pantea Akbari Pazooki, that this report dated 11/01/24 documents 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Chan informed the licensee Patea Akbari Pazooki to provide a copy of this licensing report dated 11/01/24 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
