Licensing Program Analyst (LPA) Dean Valencia conducted an unannounced complaint inspection on today's date, 9/2/2021. LPA met with the licensee, Emma Phelan who guided LPA on a tour of the facility. Census of children in care was taken, 9 children and two assistants were present. During today’s inspection the facility was operating within its licensed capacity and within compliance of ratios. During the course of the investigation, LPA interviewed licensee, 2 assistants, several parents, six children, made two separate physical inspections, and reviewed documentation related to the complaint. During an interview on 6/29/21, the licensee and 2 adult resident/assistants (adult #1 and adult #2, see LIC811 Confidential Names List) stated that neither of them have ever left any child unsupervised. Additionally, they stated that they are aware of the Title 22 Regulations related to Operation of Family Child Care Home (FCCH) and the facility operates within compliance of these regulations at all times. LPA interviewed licensee and 2 assistants on 6/30. The assistants interviewed stated that the facility and the licensee is always within compliance of Title 22 Regulations, and that everyone who supervises the children is aware of these Regulations. They stated they all always supervise the children at all times, and at least one adult is with the group of children at all times. (continued on LIC9099C)

LPA interviewed multiple parents on 8/23/21, and 9/1/21. Parents stated that they were not witness to any issues or violations at the facility nor had any concerns at the facility and had generally positive responses for their experience with the facility and the licensee. LPA also interviewed five children on 6/29/21, and on 8/24/21 LPA interviewed a sixth child. From the information obtained from the children interviews, it was not determined that the facility had violated any Title 22 Regulations, related to the allegation. From these interviews, there was insufficient information to create a preponderance of evidence to support this allegation.
Based on all this information the preponderance of evidence standard for this allegation was not met, therefore the above allegation is found to be unsubstantiated. From all of the available information obtained by LPA during the course of the investigation, that there is insufficient evidence indicating that a child obtained multiple injuries due to a lack of supervision. Based on all of the information LPA was able to obtain, LPA was not able to determine that this allegation was false or untrue. Therefore, LPA cannot make the determination that this allegation is unfounded and the most accurate finding would remain at unsubstantiated.

Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur; therefore, the allegation is unsubstantiated. Exit interview was conducted, and report was reviewed and discussed. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100 per day. The facility was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights.
