During the course of the investigation, LPA Lucero conducted interviews with the Licensee and two (2) parents.
During interview with Licensee, Licensee stated the daycare was closed from 12/24/2025 through 12/26/2025 and from 12/29/2025 through 01/01/2026. The licensee stated she informed all parents of the closures in advance and provided a written notice. The LPA obtained a copy of the notice and observed that the information was consistent with the licensee’s statement.
LPA was unable to interview children present in the daycare, as they were not qualified to participate in interviews.
LPA interviewed two parents, both of whom stated that the daycare was closed on the dates referenced above.
Based on the information obtained through interviews, there is insufficient evidence to support the allegation Licensee is not present at the facility 80% of the operating hours. Although the alleged violation may have occurred, the evidence does not meet the preponderance standard required to substantiate the claims. Therefore, the allegation is determined to be unsubstantiated.
