Licensing Program Analyst (LPA) Patricia Duron conducted an unannounced complaint visit to deliver the complaint findings. LPA met with licensee, Maribel Soto Delgadillo. Census was taken. The overall census observed was 1 staff and 2 preschool children, and 1 infant. A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 8/28/23 a complaint was filed with the Licensing office stating provider did not properly restrain day care child in vehicle. Provider did not pick up day care child in a timely manner. Per reporting party (RP), on August 2, 2023 Child #1 (C1) was transported in a vehicle with no car seat, no booster and no seatbelt. RP stated, on August 23, 2023 and August 25, 2023 C1 was not picked up from school.
During the course of investigation, LPA interviewed the 2 staff, 3 parents, 2 children, and reviewed records.

Regarding allegation: Provider did not pick up day care child in a timely manner. During the initial inspection dated 9/6/23, LPA used Language Links to conduct interview with Licensee and attempted to interview 2 children including C1, but both children refused to talk to LPA. Staff #1 (S1) stated C1 was picked up about 14 minutes late on 8/23/23 and 10 minutes late on 9/5/23 because C1’s parent called S1 to pick up C1 after school ended.

LPA Duron interviewed 3 parents. All interviewed parents stated they did not have any concern with facility.
Regarding allegation: Provider did not properly restrain day care child in vehicle.

During the staff interview, S1 and S2 stated they have car seats and booster seats for the children they pick up from the elementary school. S1 and S2 also stated they make sure the children wear seat belt when traveling in vehicles. Both staff S1 and S2 denied that they did not properly restrain day care child in vehicle.

During the inspection dated 9/6/23 and 10/24/23, LPA Duron observed 1 car seat and 2 booster seats in the facility.
Based on the information gathered from LPAs’ interviews, observation, and reviewing records, there is insufficient evidence to corroborate the allegations of provider did not properly restrain day care child in vehicle and provider did not pick up day care child in a timely manner.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day care facility, therefore the allegations are UNSUBSTANTIATED.
An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department.

The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door. Page 2 of 2. End of report.
