On 1/10/2025, Licensing Program Analyst (LPA) Silva conducted a case management – licensee initiated visit to increase the family child care home (FCCH) capacity from a small to a large license. LPA met with licensee Uthra Buddha. Uthra provided a tour of the facility. Licensee stated there are five adults and zero minor living in the home. Licensee stated she is not currently registered with any Foster Care agency or holds a foster parent license. Licensee was reminded if changes are made to notify the licensing office. Facility Day care hours are 6:00 AM - 6:00 PM, Monday through Friday. The census at the time of the visit was three infants and one child.

A review of the Facility Personnel Report Summary on this date indicates all residents, staff, or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

All areas on the Facility Sketch LIC 999 were inspected including off-limits areas. The facility is a 1-story home with 5 bedrooms, 2 bathrooms, 1 living room, a kitchen, 1 covered patio, a front yard (not fenced), a backyard (fenced), and a garage and a storage shed. There is a fireplace, located in the living room, barricaded by furniture.

The garage will not be used for daycare. The licensee stated the garage is an off-limit area. The licensee acknowledged daycare children may not enter the off-limit areas during operation hours.

The areas off-limits to children and parents are as follows: The garage, the kitchen, bedroom 2, bedroom 3, the master bedroom and restroom, and bedroom 5, the back yard and the front yard, and the storage shed. The licensee has placed child-proof safety gates at the entrance of the kitchen to ensure inaccessibility. The off-limits bedrooms are kept locked during hours of operation.

The licensee understands that licensing personnel may have access to off-limits areas during inspection visits if necessary.

Areas Designated for Day Care Activities: The applicant has designated the patio, the living room, the bedroom (bedroom 1) adjacent to the main entrance, and the restroom at the end of the hallway as daycare areas. Infants will nap in cribs or play yards and children on mats/cots in the living room and bedroom 1.

Detergents, cleaning compounds, medicines, sharp objects, and hazardous items that can pose a danger to children are inaccessible in areas designated for children. The applicant stated that there are no poisons on the premises and LPA did not observe any. The applicant was advised that any poisons must be locked with a key or combination lock. The applicant stated that there are no weapons or firearms on the premises. The LPA informed the applicant that when firearms are present, they must be locked and stored separately from the ammunition per CCR 102417(g)(4)(C).

The pressure gauge on the 2A-10BC fire extinguisher(s) indicates fully charged. The fire extinguisher type 2A-10BC must be serviced annually or as often as necessary. Smoke and carbon monoxide detectors were tested and are operable. Smoke and carbon monoxide detectors should be checked regularly and batteries replaced as needed. The pull fire alarm required by the fire department is located in the main entrance hallway.

Outdoor play activities will be conducted in the patio. The patio is appropriately fenced. LPA observed age-appropriate play equipment to be free from hazards. There are no bodies of water on the premises.

A records review indicates the applicant completed the required Health and Safety Training with Nutrition and Lead Poisoning components. The applicant has a current Pediatric First Aid and CPR certification that expires on 8/14/2026. The co-licensee Swarnalatha completed the required Health and Safety Training with Nutrition and Lead Poisoning components on 8/19/22. Swarnalatha has a current Pediatric First Aid and CPR certification that expires on 8/14/26.

In the absence of the licensee, a qualified adult must be present to supervise the children—a qualified adult is an individual who has a valid and current Pediatric First Aid and CPR certification, TB clearance and immunization, and valid criminal record clearance that is associated with the licensed facility. Annual fees must be paid by the due date, or a late fee shall be assessed and/or the License may be terminated. The licensee was reminded that all licensees must be present at least 80 percent the hours of operation per day.

The licensee does not have a current roster of children in care. A Technical Violation and plan of correction were issued. LPA reviewed 3 children’s records, which were in compliance.

H&S 1597.622: Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. The applicant has submitted proof of immunizations.

Health and Safety Code 1596.7995: Beginning January 1, 2018, all licensed providers, applicants, directors, and employees must complete training as specified on mandated reporter duties. Training is available at www.mandatedreporterca.com. The applicants have completed the required mandated reporter training. Renewal is required every two years.

Safe Sleep - Family Child Care Homes. LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/safe-sleep as an additional resource.

LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended them to register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Incidental Medical Services (IMS) policy was discussed. Licensee stated she is not currently administering medication. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Licensee was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Family Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Fire clearance granted on 11/20/24

During todays’ inspection, there were no deficiencies cited and licensee was in compliance with California Code of Regulations Title 22 for operating a Family Child Care home.

A new license for operating a Large Family Child Care Home shall be issued upon final review. In the event additional requirements are needed, the applicant will be notified. A license will be issued once all requirements are met.

Exit interview conducted and report was reviewed with the licensee, Uthra Buddha. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

During the exit interview, the licensee Uthra Buddha confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

Appeal Rights were explained. The Licensee was provided a copy of appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
