An office meeting was conducted on this day, 02-08-2024, in the Orange County Regional Office. In attendance was Regional Manager (RM) Bertha Manzanares, Licensing Program Manager (LPM) Judy Hanson, Licensing Program Analyst (LPA) Karen Navar, LPA Cindy Nguyen and Applicants Mingqiong Zhang & Hanjie Zhang. Interperter LU #83995614 Also present was the licensee’s attorney Scott Harris.

For the purpose of this report the Department acknowledges Mingqiong Zhang & Hanjie Zhang are current Licensees and operating a Family Child Care Home located 87 Rembrandt Irvine CA 92620. In this report Mingqiong Zhang & Hangji Zhang will be identified as Applicants due to the application submitted for relocation.

The purpose of this Office meeting is to discuss the application submitted for relocation from 87 Rembrandt, Irvine, CA 92620 to 111 White Jasmine, Irvine, CA 92618.

During the meeting RM, Manzanares issued and reviewed the following regulations.

· Title 22 Division 12 102352(f)(1) “Family Day Care” or “Family Child Care” means regularly provided care, protection, and supervision of children, in the care giver’s own home was reviewed and discussed.

Title 22 Division 12 102352(h)(1) "Home" means the licensee's residence as defined by Government Code Section 244. In determining the place of residence, the following rules shall be observed: It is the place where one remains when not called elsewhere for labor or other special or temporary purpose, and to which he or she returns in seasons of repose. There can only be one residence. A residence cannot be lost until another is gained.

On 12/13/2023 during the pre-licensing interview, applicant Hanjie Zhang stated that they are operating a childcare at their current facility at 87 Rembrandt, Irvine, CA 92620 and will transfer children to applicant Mingqiong’s home located at 111 White Jasmine, Irvine CA 92618 once the facility is licensed. Applicant Hanjie asked LPAs Navar and Trinh “How many hours do you have to be in the home for it to be considered living there?” During today’s meeting applicants stated they currently reside at 87 Rembrandt Irvine CA. Applicants indicated that there are 3 tenants residing at 111 White Jasmine Irvine CA. Hanjie stated that the tenants will remain in the home.Mingqiong stated that the tenants will stay. Applicants stated they will move in by February 19th, 2024.

Applicant, Mingqiong Zhang stated she has a clear understanding of Title 22 Division 12 102352(f)(1) & Title 22 Division 12 102352(h)(1) _____ initials.

Applicant, Hanji Zhang stated she has a clear understanding of Title 22 Division 12 102352(f)(1) & Title 22 Division 12 102352(h)(1) _____ initials.

RM, Manzanares issued and reviewed the Decision & Order, specifically the section “Order” dated February 23, 2023, for terms of probation for the following:

· CDSS 6621218101(License Revocation)

· 6621218101B, (Exclusion Action)

· 6621218101C (Exclusion Action)

The Decision & Order indicates; During the probation period, on a semi-annual basis, no later than six months from the effective date of this decision, Mingqiong Zhang and Hanjie Zhang shall complete a one-hour course/seminar related to the operation of their family childcare home. Prior to attending the course, respondents shall obtain written approval of the course from the department. No later than five business days of completion of the course respondents shall provide written proof of completion of the course.

RM, Manzanares, inquired as to the reason the Applicants had followed the Decision and Order regarding the approval of courses. Applicant Mingqiong stated she was not aware they need to submit for approval. Applicant Hanji recalled an email was sent to the Analyst for the approval; however since a response was not received by the Analyst they proceed in taking the courses. Applicants both indicated they have taken (3) courses as required by the Decision and Order.

During the meeting Attorney Harris suggested the Decision & Order be reviewed with the Applicants. RM, Manzanares reviewed the Decision & Order section Order 1 a-f. Applicants did not have any question, except as to who they would contact to submit the approval of the courses.

RM, Manzanares introduced LPA Cindy Nguyen to applicants who will be the assigned analyst once licensed. RM, Manzanares advised Applicants. if an email is sent and they do not a received response from Analyst within two weeks Applicants would contact a member of the Management Team. Applicants will submit proof of the (3) courses no later than Friday, February 16, 2024.

The Decision and order was reviewed with applicants.

Mingqiong Zhang and Hanjie Zhang shall obey all laws of the United States and the State of California and shall comply with all statutes and regulations that govern operation of Department licensed family childcare homes.

During probation period, at its discretion, the Department shall make announced and unannounced visits to the facility to ensure compliance with the statutes and regulations that govern operation of department licensed family childcare homes.

Should Mingqiong Zhang and Hanjie Zhang violate any of the terms and conditions of this Order, the Department may lift the stay and impose the revocation. Said action shall only occur after filing of a Petition to Revoke Probation and hearing upon due notice.

Upon completion of the terms of probation, Mingqiong Zhang and Hanjie Zhang’s license shall be without further Department restriction except as governed by applicable statutes and regulations.

The following was issued and reviewed with Applicants, Active Supervision At-A-Glance and Staffing Ratio and Capacity handouts.

The following was discussed with the applicants:

1. The facility must be in compliance at all times.
2. The applicants will meet all conditions of Probation.
3. The applicants were advised that subsequent citations may result in civil penalties and a revocation of their license.

The Orange County Regional office will proceed with the relocation license that will be effective on Monday February 19, 2024.

The exit interview was conducted with applicants Mingqiong, Zhang and Hanjie, Zhang and a copy of this report was given to Mingqiong, Zhang and Hanjie, Zhang who agrees with the above.
