On 2/3/2025, Licensing Program Analyst (LPA) Cynthia Sun conducted an initial 10-day investigation regarding the above allegation. LPA Sun met with licensee Erikendy Rodriguez who accompanied the LPA on a tour of the facility. Upon arrival at 12:10pm, LPA observed licensee alone caring for 4 infants (ages 0-24 months old) and 4 preschoolers (ages 2 to 3 years old) Children were sleeping in their cribs/playpens. Licensee was operating facility out of ratio.

A review of staff records on this date 2/2/25 indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions. During today’s inspection, LPA Sun obtained facility roster.

On 01/27/2025, Orange County Regional Office received a complaint alleging the facility provider is using a baby walker in the daycare. The Reporting Party (RP) stated the facility had publicly posted videos of the violations on facebook.com. LPA reviewed the video on Facebook and observed a child was using the baby walker. During today’s visit, LPA confirmed the child that was using the baby walker in the video was the daycare child. LPA also observed two baby walkers in the child care room.

Based on LPA observation and staff interview, the preponderance of evidence standard has been met, therefore the allegation of provider is using a baby walker at the daycare was found to be SUBSTANTIATED. California Code of Regulations, Title 22 Chapter 3 102417(g)(10) Operation of a Family Child Care Home is being cited on the attached LIC 9099D.

Exit interview was conducted. The Notice of Site Visit was posted. Licensee was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Appeal Rights explained. The Licensee was provided a copy of their appeal rights (LIC 9058 01/2016) and their signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report.
