On 06/04/2025, the Orange County Child Care Office received a complaint alleging: (1) Licensee is not present 80 percent of operating hours, and (2) Licensee did not meet daycare child's needs. Reporting Party (RP) stated that licensee was not meeting Child #1 (C1) needs, and that licensee was not present in the daycare home 80 percent of the operating hours and an unqualified substitute was supervising the children in care.
During the investigation, LPA toured the daycare home on 06/10/2025 and 07/17/2025 conducted 2 (two) staff interviews, obtained a copy of Child Care Facility Roster, Written Declaration, and reviewed records for C1. Children had limited vocabulary and did not qualify for interviews.
Regarding allegation (1) Licensee is not present 80 percent of operating hours: During unannounced visits to the home daycare on 6/10/2025 at 12:20 PM and 07/17/2025 at 9:03 AM LPA met with Licensee Joselin. Licensee stated that she starts taking children at 4:30AM and the end time is around 5:30/6:00PM. Licensee stated that she does have a fully qualified assistant (staff) who comes in for 5 hours a day on Tuesday-Fridays. Two (2) staff interviews (S1-S2) stated that on occasion the licensee will step out for small errands like groceries or appointments and that the time away from the home day care does not exceed Title 22 Regulation 102417(a) Operation of a Family Child Care Home. (a) The licensee shall be present in the home and shall ensure that children in care are supervised at all times. When circumstances require the licensee to be temporarily absent from the home, the licensee shall arrange for a substitute adult to care for and supervise the children during his/her absence. Temporary absences shall not exceed 20 percent of the hours that the facility is providing care per day. LPA conducted a file review for one (1) staff and the records showed staff 1 (S1) was fully qualified with Title 22 requirements for personnel records.
Regarding allegation (2) Licensee did not meet daycare child's needs: During home daycare inspections on 6/10/2025 and 07/17/2025, LPA toured the home and observed S1 and S2 engaged and supervising children with their needs. Two (2) interviewed staff stated that they would take C1 for walks, provide play time, sit with C1 for comforting methods, try to meet C1’s needs the best of their ability, follow doctors’ medical notes, and parents request.
