Licensing Program Analyst (LPA) Thompson conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 6/11/2024. Upon arrival LPA met with licensee Jaimes Benita, to deliver complaint findings. LPA toured the facility inside and outside. LPA observed a total of 4 children along with licensee and her assistant.

A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. During today’s inspection the facility was operating within its licensed capacity and within compliance of staffing ratios. Licensee has a current license for a large family childcare home and can care up to 14 children with an assistant present.

On 6/10/2024 the Orange County Child Care Office received a complaint with one (1) allegation licensee is operating out of ratio.

Reporting Party (RP) indicated there are 15 plus children attending the day care Monday through Friday.

During the investigation on 6/11/2024, upon arrival at the family childcare home, LPA observed licensee and one assistant caring for 10 children. LPA interviewed licensee and licensee stated she has never been out of ratio. Licensee stated she only has 12 children enrolled and provided LPA with the childcare facility roster that show 12 children were currently enrolled at the time of visit. Licensee also provided LPA with Brightwheel sign in/sign out logs. Brightwheel shows eleven children that sign in/sign out. Licensee stated one parent is not using the Brightwheel app.

On 6/24/2024, LPA conducted parent interviews via phone call. LPA called eight parents and four parents were able to be interviewed. Parents interviewed did not divulge any information pertaining to the allegation.

Based LPA observation, documentation, interviews with licensee and parents, there was not enough evidence to substantiate the allegations.



The Orange County Child Care Office has investigated the complaint alleging licensee is operating out of ratio: although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

In the areas that were evaluated, no deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit.



Exit interview conducted and report was reviewed with licensee Jaimes Benita.

Notice of Site Visit was provided to licensee Jaimes Benita and posted on the door. The notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The licensee was provided a copy of their appeal right (LIC 9058 1/16) and their signature on this form acknowledges receipt of these rights. Exit interview was conducted.
