Licensing Program Analyst (LPA) Nguyen conducted an unannounced investigate the above allegation. This is a continuation of the investigation initiated on 08/03/21. LPA met with the Interim Director, Sheila Dalva-Hornback and informed her the purpose of the investigation inspection. At 12:35 pm a census was taken. Observed were 130 preschool age children with 26 staff members. During today's inspection staffing ratios were being met and the facility was operating within its licensed capacity. A review of staff criminal records indicates all facility staff or individuals who require caregiver background checks have received a criminal record clearance or exemption and a child abuse index clearance.

On 08/02/2021 a complaint was filed with the Department alleging that a teacher pinched a daycare child causing bruising. In addition to receiving a complaint, the director self-reported the incident on 08/03/2021 documenting the parent’s concern. During the investigation LPA conducted 2 physical plant inspections, interviewed staff members, parents, children, obtained facility discipline policy, obtained a copy of Irvine Police Report, and a copy of the children's roster. Complainant alleged that on July 30, 2021 Staff #4 (S4) pinched Child #12 in care caused the bruising on the child back. All staff interviewed denied ever observing S4, or any other staff, pinching any children. However, Staff #5 (S5) & Staff #6 (S6) interviewed stated that on occasions S5 & S6 have observed S4’s voice being loud, not threatening, but to get the children’s attention. However, the raised voice could be a little intimidating the children. Child #12 (C12) was not available to be interviewed by the LPA, however, C12 was interviewed by the Irvine Police Department (IPD). The IPD report stated C12 received the pinch because C12 was misbehaving and fighting with another child. It is unclear how and when exactly the pinch may have occurred. It is unknown if the bruises were the result of a pinch that could have occurred while the children were being separated or if it was the result of the two children wrestling with each other. The children interviewed were either too young to qualify or did not disclosed any information to support the allegation. All parents interviewed did not express any concerns with the care given to the children, or have any other issue with any staff at the facility. Parents stated they would recommend facility to others.

Based on LPA observations, document reviews and interviews which were conducted, the preponderance of evidence was not met, therefore the above allegation is found to be UNSUBSTANTIATED. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Exit interview was conducted with Interim Director, Sheila Dalva-Hornback and & Jamie Fitzhugh . Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
