On 3/05/2026, the Orange County Regional Child Care Licensing Office received a complaint with one allegation listed above: Staff force day care children to nap.
During the course investigation, LPA interviewed four (4) staff members, four (4) children, and four (4) parents. LPA also obtained a copy of the children’s roster, staff roster, and documents pertinent to the investigation.
Four (4) out of four (4) staff members denied that they have forced a child to take a nap before when the child did not want to. Four (4) out of four (4) staff members stated that there are activities on a table for the students who do not fall asleep during nap time. Three (3) out of four (4) children were eligible for the interview. Two (2) out of three (3) children stated that a staff member will ask them if they want to do activities during nap time if they don’t want to take a nap.
During the visit on 3/10/2026, LPA observed two of the facilities rooms during nap time. LPA observed the blinds were down, LPA can see the floor and everything in the classrooms, the rooms were not dark or blackout, and the music was not loud. LPA contacted five (5) parents, only four (4) parents responded. All interviewed parents stated they did not have any concern related to the allegation. LPA reviewed the facility’s parent handbook and there was information regarding nap time. It indicates that the facility will have a rest period for children staying 6 hours or more, nap needs vary by child, and teachers will support their rhythms without pressure to sleep or stay awake.
Based on the information gathered from LPAs’ interviews, observations, records, the preponderance of the evidence has not been met. Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation of Staff force day care children to nap, therefore, the allegation is UNSUBSTANTIATED.
A notice of site visit was given and must remain posted for 30 days. Appeal rights were given.
