Licensing Program Analyst (LPA) Nguyen Nick Tran conducted an unannounced complaint inspection to deliver the findings for the above allegations. This is a continuation of the investigation initiated on 03/01/2024. At 2:15pm, LPA Tran met with Director, Sheila Dava-Hornback and informed the Director the purpose of the visit, LPA conducted observation in the infant classrooms. Census was taken and observed were 8 napping infants and 1 staff member in the napping room, 4 napping infants and 1 staff in another napping room and 6 infants and 2 staff members in the play area of the infant room.

A review of the Facility Personnel Report Summary on 05/07/2024 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 02/29/2024, the Regional Office received a complaint with allegations alleging (1) Staff handled day care children in a rough manner and (2) Staff did not tend to day care children’s emotional needs.

During the investigation, LPAs conducted observations on 03/01/2024, 04/11/2024 and 05/07/2024, interviewed 14 staff members and 6 parents.

During observations, LPAs did not observe any staff handle the infants in a rough manner. LPA also observed staff members attended to the children’s needs as soon as they noticed child wants something or cry.

During interviews with 14 staff members, LPA received conflicting information from witnesses regarding the allegations about Staff #1 handled the day care children in a rough manner and Staff #1 did not tend to day care children’s emotional needs. LPA also left 3 voice messages and sent an email in attempts to interview a substitute teacher, who is from another childcare agency, but received no response. All interviewed parents provided good feedback about the services their children are receiving from the facility and has no concern related to the allegations. LPA did not interview the children as they are infants and are not verbal.

Based on the information gathered from LPA observations on 03/01/2024, 04/11/2024 and 05/07/2024, and interviews with 14 staff members and 6 parents, there is insufficient evidence to corroborate the allegations that (1) Staff handled day care children in a rough manner and (2) Staff did not tend to day care children’s emotional needs, therefore, the allegations regarding (1) Staff handled day care children in a rough manner and (2) Staff did not tend to day care children’s emotional needs, are unsubstantiated.

Appeal Rights were explained. The Licensee was provided a copy of appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Director Sheila Dalva-Hornback.
