32 | During the course of investigation, LPA interviewed 10 staff members, and 5 parents, and reviewed records. Children were not interviewed due to their age and being non- verbal.
Regarding allegations staff handled day-care child in a rough manner:
LPA interviewed 10 staff members, 10 out of 10 staff stated they have not witnessed any staff handle any day-care child in a rough manner. LPA reviewed video footage dated 10/27/23. LPA observed on video at 10:45am C1 was sleeping on the carpet in the classroom. At 10:46am Staff #1(S1) walks over to C1 and lifts up sleeping child, staff placed their hands under C1’s arm pits. S1 lifts up child about 8 inches from the ground and lowers child again, S1 lifts and lowers C1 several times. C1 knees bend and their knees touch the floor. C1 sat on the carpet on their knees, then S1 lifts child again, and child begins to jump up and down as they move their legs off the ground. C1 places feet on the ground, and S1 holds C1 hand and walks away with child.
LPA Duron interviewed 5 parents. All interviewed parents stated they did not have any concern with facility.
Based on LPA’s interviews, and reviewing video footage, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101223 Personal Rights (a)(3). Please refer to attached 9099D for documentation of deficiencies.
This requirement is met as evidence by: Based on LPA’s interview and observation of video footage of incident that documents S1 handing C1 in a rough manner, which poses an immediate health risk to the children in care.
LPA Duron informed Director, Sara Ortiz that this report dated 1/24/2024 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. LPA Duron informed the Director to provide a copy of this licensing report dated 1/24/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
