Licensing Program Analyst (LPA) Patricia Duron conducted an unannounced complaint visit to deliver the complaint findings. This is a continuation of the investigation initiated on 1/17/24 , LPA met with Director, Sara Ortiz and informed the director of the purpose of the visit. The director guided LPA on a tour of the facility and a census was taken. The overall census observed was 7 infant staff and 16 infants.
A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 1/12/24 a complaint was filed with the Licensing office stating staff are not handling day care children in an appropriate manner. Reporting Party (RP) stated the caregivers often picking up kids incorrectly off the floor. There was absolutely no head support and in some cases children were often picked up by their arms from the floor which can cause dislocation of the arm if done in the incorrect manner.

During the course of investigation, LPA interviewed 7 staff members, 5 parents, and reviewed records. LPA unable to interview children due to their age and being nonverbal.

During the staff interview, LPA Duron 7 out of 7 staff did not witness staff handle day care children in an inappropriate manner. Staff 7 (S7) stated on 1/12/24 director went over policies and all staff members were provided training on how to properly hold a child, how to diaper, and how to feed children.

LPA reviewed video footage dated 1/10/24. LPA observed on video S1 on the floor on their knees, holding Child 1 (C1) who is three months old. S1 held C1 with left arm, as C1 legs were on either side of S1 waist. S1 leaned down toward another child lying on the carpet to give the child a bottle. This child was able to hold the bottle by self. When S1 leaned down toward the child laying on the floor, C1’s upper body was leaning too. As S1 stood up, C1’s upper body leaned further back and swayed from side to side. S1 continued to walk as S1 placed right arm under C1’s bottom. There was no support from S1 to C1’s upper body.

LPA Duron interviewed 5 parents. 5 out of 5 parents did not have any concern with the facility.

Based on information gathered from LPA’s video footage review, the preponderance of evidence standard has been met, therefore the above allegation has found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101223 Personal Rights (a)(1). Please refer to attached 9099D for documentation of deficiencies.


9090D: 101223 Personal Rights(a)(1) The licensee shall ensure that each child is
to be accorded dignity in his/her personal relationships with staff and other persons.
This requirement is not met as evidence by: based on video footage review, S1 did not provide adequate support when holding C1 whom is 3 months old. Which poses an immediate health risk to the children in care.

LPA Duron informed Director, Sara Ortiz that this report dated 3/29/2024 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. LPA Duron informed the Director to provide a copy of this licensing report dated 3/29/24 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department.

The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door.

Director provided a written statement to LPA staing on 1/12/24 she went over policies with staff and all staff members were provided training on how to properly hold a child, how to diaper, and how to feed children. On 1/12/24 a complaint was filed with the Licensing office alleging (1) Staff are not following proper feeding methods (2) Staff forced an object into day care child's mouth. Reporting Party (RP) stated, a caregiver was bottle feeding a child as the child was laying flat on the floor which should never take place and should always be held up when feeding. RP stated a caregiver who held child was being extremely rough with child and forcing the pacifier in child’s mouth as child kept crying. Page 1 of 2.

Regarding allegations (1) Staff are not following proper feeding methods

LPA interviewed 7 staff members, 7 out of 7 staff stated staff are following proper feeding methods. S1 stated “We hold them on our lap and feed them the bottle. We feed them every 2 to 3 hours or 4 hours or when they are hungry.” S2 stated “We hold them in our arms while they drink their bottle if they are unable to hold their bottle.” S6 stated “We hold the baby. When they are older, we still hold them, but they can hold their own bottle.”

Regarding allegations (2) Staff forced an object into day care child's mouth

LPA interviewed 7 staff members. 7 out of 7 staff stated they have not witnessed a staff force an object into day care child’s mouth. 7 out of 7 staff stated they have not witnessed a staff member force a pacifier into an infant’s mouth.

LPA reviewed video footage dated 1/10/24. LPA observed on video S1 was holding C1 with left arm as S1 leaned down toward another child lying on the carpet, S1 picked up a bottle from the carpet and handed bottle to child lying on the carpet. LPA observed the child lying on the floor was able to hold the bottle by self. LPA did not observe any staff force any object into a child’s mouth while reviewing the video footage.

LPA Duron interviewed 5 parents. All interviewed parents stated they did not have any concern with facility.

Based on the information gathered from LPAs’ interviews, observation, and the reviewing of records, there is insufficient evidence to corroborate the allegations: Staff are not following proper feeding methods and Staff forced an object into day care child's mouth. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day care facility, therefore the allegations are UNSUBSTANTIATED. An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department.
