32 | During the course of investigation, LPA interviewed 7 staff members, 5 parents, and reviewed records. LPA unable to interview children due to their age and being nonverbal.
During the staff interview, LPA Duron 7 out of 7 staff did not witness staff handle day care children in an inappropriate manner. Staff 7 (S7) stated on 1/12/24 director went over policies and all staff members were provided training on how to properly hold a child, how to diaper, and how to feed children.
LPA reviewed video footage dated 1/10/24. LPA observed on video S1 on the floor on their knees, holding Child 1 (C1) who is three months old. S1 held C1 with left arm, as C1 legs were on either side of S1 waist. S1 leaned down toward another child lying on the carpet to give the child a bottle. This child was able to hold the bottle by self. When S1 leaned down toward the child laying on the floor, C1’s upper body was leaning too. As S1 stood up, C1’s upper body leaned further back and swayed from side to side. S1 continued to walk as S1 placed right arm under C1’s bottom. There was no support from S1 to C1’s upper body.
LPA Duron interviewed 5 parents. 5 out of 5 parents did not have any concern with the facility.
Based on information gathered from LPA’s video footage review, the preponderance of evidence standard has been met, therefore the above allegation has found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101223 Personal Rights (a)(1). Please refer to attached 9099D for documentation of deficiencies.
9090D: 101223 Personal Rights(a)(1) The licensee shall ensure that each child is
to be accorded dignity in his/her personal relationships with staff and other persons.
This requirement is not met as evidence by: based on video footage review, S1 did not provide adequate support when holding C1 whom is 3 months old. Which poses an immediate health risk to the children in care.
LPA Duron informed Director, Sara Ortiz that this report dated 3/29/2024 documents one Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. LPA Duron informed the Director to provide a copy of this licensing report dated 3/29/24 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
