A complaint inspection was conducted on this date 6/10/22 by Licensing Program Analyst (LPA) Dean Valencia. LPA met with director Cheyanne Hall and Assistant Director Mary Joy to discuss the above allegation. During the inspection a physical plant inspection/walk-through was conducted, census was taken, and 5 children were interviewed. At the time of the physical plant inspection/walk-through, 28 children were in care being supervised by 5 staff. This is a continuation inspection initiated on 4/29/22. During the course of the investigation, LPA conducted 2 seperate physical plant inspections, interviewed 6 staff and 5 children as well as attempted to interview 2 additional children including a child #1; and gathered and reviewed extensive documentation related to the allegation including correspondance between the reporting aprty and facility, incident/ouch reports, sign in/out documentation, and updated Plan of Operation and Admission Agreement. During LPA's observations of the classrooms, LPA observed preschool staff supervise the children at all times, and remaining in compliance of children's personal rights. Staff were interviewed by LPA on 4/29/22 and during the interviews staff exhibited knowledge of personal rights regulations and stated they are always to be within complaince of the discussed Title 22 Regulations. LPA observed in the classrooms that staff remain within compliance of children's personal rights and supervise the children appropriately. From staff interviews and review of records gathered, it was determined that a child #1 (see Confidential Names List LIC811), had been accorded their personal rights including not interfering with their right to rest when they request to do so. Also observed was that the designated isolation area, director office, where child #1 was in has a nap mat available should child #1 or any child in the office, request to rest and/or nap. Based on this gathered information the allegation of Child not free from actions of a punitive nature including interference with sleeping was not determined to have a preponderance of evidence. In addition to this, LPA was unable to demonstrate that this allegation, or that the children's personal rights were not ever violated, was untrue. LPA was unable to make the determination from the information gathered that this allegation did not ever occur, or that there wasn't a preponderance of evidence to support this allegation, at some point. Due to this reasoning the most factual finding on the allegation, with all available information to LPA during the investigation is unsubstantiated.

Based on all this information LPA gathered, the preponderance of evidence standard for the allegation was not met, therefore the above allegation is found to be unsubstantiated. From all of the available information obtained by LPA during the course of the investigation, that there is insufficient evidence indicating that Child not free from actions of a punitive nature including interference with sleeping. Based on all of the information LPA gathered, LPA was not able to determine that this allegation was false or untrue. Therefore LPA cannot make the determination that this allegation is unfounded; and the most accurate findings would remain at unsubstantiated.

Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur; therefore, the allegation is unsubstantiated. Exit interview was conducted, and report was reviewed and discussed. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100 per day. The facility was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights.
