Licensing Program Analyst (LPA), Mahnaz (Nancy) Malek conducted an onsite case management inspection for the purpose of investigating an incident that the facility self reported to our office on 1/3/2025.
LPA met with Assistant director, Sandra Johnson. The director, Mary Joy Hilsabeck was not present. Census was taken. There were a total of 56 napping preschool children with 6 staff. Twelve children with one staff in PreK, fourteen children with 2 staff in the 2 year old room, ten children with one staff in Preschool 1, Nine children with one staff in Preschool 2, and eleven children with one staff in TK room. Village Room was not in use. According to the self incident report, a 3 year old child was found in the hallway of the facility and away from the group. This happened during transitioning time from one room to another room on 1/2/2025 around 11:50 am.
A review of the Facility Personnel Report Summary on this date indicates all facility who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
LPA interviewed the staff who had information regarding this incident. Staff # 1 (S1) and S2, and the 3 year old child (C1).
LPA interviewed S1 who stated on 1/2/2025, S1 took a group of children from Preschool 1 to Preschool 2 to get some belongings for children's napping. S1 returned to Preschool 1 after getting the supplies needed. S1 stated some children ran around in the hallway. According to S1, S1 was standing at the door of the classroom when children were in the hallway. S1 denied leaving the child unattended in the hallway. S1 continued that S1 could see part of C1's body in the hallway and no child was out of the sight of S1.
LPA interviewed S2 who stated on 1/2/2025 S2 was in the lobby when S2 heard a child's crying. S2 went to the hallway and found C1 being left unattended behind the close door of Preschool 1. According to S2 the timing of being left unattended is estimated under one minute. S2 stated S2 opened the classroom door, delivered the child to S1, and brought it up to S1's attention. S1 did not acknowledge that C1 was left behind in the hallway. According to S2 the video footage was reviewed by the upper management and the Continued on page 2

time frame for C1 being left unattended was estimated 19 seconds. However, the video footage was not available for LPA's review due to time sensitivity.

LPA also interviewed C1 who was qualified for interview. C1 told LPA that C1 was left alone in the hallway behind closed classroom door (Preschool 1). C1 stated that S2 found C1 and took C1 back to the classroom. C1 stated S1 was inside the classroom. C1 stated C1 was walking slowly behind the group of children and S1 did not see C1.

LPA reviewed the internal name to face transition sheet dated 1/2/2025 around 12:00 pm. It showed at the time of incident there were 11 preschool children with S1.

Base on the self reported incident, staffs' interviews, C1's interview, and reviewing documents related to the incident, it was determined the facility failed to provide visual supervision of a child in care, therefore, California Code of Regulations, Title 22, Division 12, Section 1014229(a)(1)- Responsibility for Providing Care and Supervision is being cited on the attached LIC 809D. This is a repeat of same violation within 12 months. A civil penalty of 1000.00 was assessed today.

The facility representative, Sandra Johnson was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. The “Notice of Site Visit” must be posted on or adjacent to the door. Failure to post will result in Civil Penalty of $100.00. LPA Malek informed the facility representative, Sandra Johnson that this report dated 1/9/2025 documents type A citation shall be posted for 30 consecutive days as there is immediate risks to the health, safety, or personal rights of children in care. Also, LPA Malek informed the facility representative, Sandra Johnson to provide a copy of this licensing report dated 1/9/2025 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report.


A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. The facility representative, Sandra Johnson was provided with a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.

The exit interview was conducted with the facility representative, Sandra Johnson.

The facility representative agreed to send a statement with staffs' signatures acknowledging the importance of supervising children at all times. Also the facility representative will review the procedure of name to face during transition procedures with all staff.

This requirement was not met as evidenced by a self report incident, and staffs' and child's interviews that S1 left 3 year old child unattended in the hallway during transitioning from one room to another for less than a minute. This is an immediate risk to the health and safety of children in care. This is a repeat same violation within 12 months. An immediate civil penalty of 1000.00 was assessed today.
