During the investigation, LPA toured the facility and obtained pertinent documents. LPA also conducted interviews with the reporting party, 6 staff members, 5 parents, and 5 children.
Regarding the allegation of “Minor sustained an injury due to staff neglect”
During the staff interview, 3 out of 6 interviewed staff confirmed the incident with C1. Staff # 2 (S2) stated that the staff do not provide 100 percent supervision to children in care because they need to input and finish the Daily Activities Report on the ipads before 3:00PM while they are outside supervising the children. Staff # 3 (S3) stated that there is a lack of supervision because staff need to input and finish the Daily Activities Report on the ipads before 3:00PM while they are outside supervising the children. Staff #6 (S6) stated that S6 was present and did not witness when the child fell off the swing because S6 was busy supervising other children.
Staff # 1 (S1), Staff # 4 (S4), Staff # 5 (S5), and S6 denied the allegation above. However, S1, S4, and S5 were not present or witnessed the incident. 6 out 6 interviewed staff stated that the facility’s care and supervision policy is to scan the whole yard, watch out for blind spots, and provide 100 percent visual supervision for all children in care
During the parent interview, 4 out of 5 interviewed parents did not divulge any information pertaining to the allegation.
Based on LPA’s observations, and interviews, the preponderance evidence of Minor sustained an injury due to staff neglect has not been met. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated.
Exit interview was conducted and report was reviewed with the Site Supervisor Stephanie Nord.
Notice of Site Visit was posted during the visit. The facility representative was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.Appeal Rights were explained. The facility representative was provided with a copy of the appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
