Licensing Program Analysts (LPAs), Mila Quinto and Diana Valdez Santana conducted investigation visit to the facility to deliver the findings of the complaint from the complaint initiated on 11/02/21 regarding staff member bullied day care children; staff member made inappropriate comments to day care children; staff member handled day care child in a rough manner. LPAs met with Assisstant Director, Monique Gonzales. The Covid-19 Emergency Response questionnaire was reviewed and answered by the assistant director. LPAs toured the facility with the assistant director. Census was taken. There was a total of 13 school age children with 1 staff. At 2:15pm, Director, Perla Arrieta arrived at the facility.

A review of facility Personnel Report Summary on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The complainant alleged staff member bullied daycare children. According to the complainant Child 1(C1) and Child 2 (C2) have been singled out and humiliated by Staff 2 (S2). On 11/19/21, LPA conducted an interview with 4 staff including the director and 14 school age children. According to the director, C1 was on a behavioral plan due to ongoing behavior issues. The director had multiple conversations with the parents regarding C1’s behavior issues, LPA viewed C1’s file, which had several incidents pertaining to behavior issues. The director stated that the school also had a conference with parent and suggest that they partner together to help C1 with the behavior issues. The school and the parent worked together with C1 but were unsuccessful. There were no other disclosures from the director. Staff 2(S2) stated C1 has more energy than the other children in the classroom, so she had to constantly redirect C1 and remind him to behave. LPA interviewed staff members #3 and #4, they denied hearing or seeing any staff bulling any children in the classroom. LPA interviewed 14 school age children. Child 6 (C6) stated C1 used to get in trouble as C1 was not nice and not respectful to teachers. Child 7(C7) stated C2 made fun and yell at other children. There were no disclosures from the other 12 children interviewed. On 12/14/21, LPA called 11 parents of which 6 of the 12 were interviewed. There was no disclosure from the 6 parents. LPA did not receive a call back from the other 6 parents. On 1/24/22, LPA called and left a message for parent, LPA requested a return call so she could interview C1 and C2, however no return call was received.

This agency has investigated the complaint alleging staff member bullied daycare children. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

The complainant alleged staff member made inappropriate comments to day care children. The parent of C1 and C2 called the District Manager of Tutor Time regarding this issue. The District Manager indicated that they would look at the video footage, although it does not have audio, to see if they are able to verify the inappropriate comments. According to the complainant, on various occasions, S2 would make inappropriate comments to C1 and C2 such as they should not be rewarded since they are bad. On 11/19/21, LPA conducted an interview with 4 staff including the director and 14 school age children. The director stated that they conducted an inhouse investigation, per District Manager's request, the video footage was reviewed and S2 was interviewed. The director stated that S2 denied making any inappropriate comments to C1 and C2.

There were no disclosures from the 4 staff interviewed regarding inappropriate behaviors, all staff denied hearing anyone make inappropriate comments. LPA interviewed 14 school age children and no disclosures made from the children interviewed. On 12/14/21, LPA called 11 parents of which 6 of the 12 were interviewed. There was no disclosure from the 6 parents. LPA did not receive a call back from the 6 parents. On 1/24/22, LPA called and left a message for parent, LPA requested a return call so she could interview C1 and C2, however no return call was received.

The complainant alleged staff member handled day care child in a rough manner. According to the complainant, C2 saw S2 grab C1 by the arm pulling him up from the floor. On 11/19/21, LPA conducted an interview with 4 staff including the director and 14 school age children. According to the director, the parent called director regarding C2 seeing S2 grabbed and pulled C1 from the carpet. LPA interviewed 14 school age children from the same classroom; none of the children stated that they witness S2 grab C1 or any other children. On 12/14/21, LPA called 11 parents of which 6 of the 12 were interviewed. LPA reviewed S2’s file and did not see any performance issues, all trainings were up to date. There was no disclosure from the 6 parents. On 1/24/22, LPA called and left a message for parent, LPA requested a return call so she could interview C1 and C2, however no return call was received.

This agency has investigated the complaint alleging staff member handled day care child in a rough manner. Although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

Exit interview was conducted. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
