The Reporting Party (RP) reported concerns regarding napping procedures in the Early Preschool classroom. The RP alleged that on January 28, 2026, Child #1 (C1) was physically restrained by Staff #1 (S1). Specifically, the RP stated that C1 did not want to nap, and S1 positioned themselves next to C1 to keep the child in place. When C1 attempted to move away, S1 allegedly pulled C1 back, preventing the child from independently repositioning. The RP further alleged that S1 made repeated hand motions in front of C1’s face in an attempt to soothe the child and encourage sleep. When C1 extended their hand outward, S1 reportedly pushed the child’s hand away. The RP indicated that no alternative quiet activity was offered to C1 prior to requiring the child to nap.
As part of the investigation, LPA Lucero conducted interviews with six (6) staff members and two (2) parents.
During interviews, staff denied the allegations and stated they had not observed any staff member forcing children to nap or engaging in inappropriate physical handling of children. Staff also expressed no concerns regarding S1.
Parents interviewed reported no concerns relating to these allegations.
LPA attempted to interview children from alleged classroom but children were not qualified for interview.
Based on LPA's interviews, it has been determined there was no preponderance of evidence supporting (1) staff forced a daycare child to nap, (2) staff inappropriately restrained a daycare child and (3) staff mishandled a daycare child.
Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are found to be Unsubstantiated.
Exit interview was conducted with Assistant Director Rosalia Altamirano. The Notice of Site Visit was posted.
