C1 then throws themselves onto the floor. S1 uses one hand to pick up C1 by the left wrist and the other hand is grabbing C1's left arm and makes C1 stand. S1 then starts moving C1 towards the activity table and pulls out a chair for C1. S1 then places right leg behind C1 pinning C1 against the table meanwhile S1 is talking to S2, C1 is observed crying and attempting to walk away. S1 then picks up C1 by the arms and sits C1 on the chair and moves the chair at an angle. S1 then grabs the chair next to C1 and scoots closer to C1 and uses their right leg to block in C1. C1 is observed crying and trying to push their way out. C1 is unable to leave from the table, as C1 is blocked by the table and S1's leg. S1 is then observed shaking their head “no” to C1 and holding onto C1's chair.
On 11/28/2023, LPA attempted to interview C1, however C1 did not qualify to be interviewed.
On 01/05/2024, LPA attempted to interview 4 children, however children were not qualified for interviews.
Based on LPA’s interviews conducted with 3 staff, RP and video footage reviewed it has been determined staff handled a day care child in a rough manner. Therefore, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated. California Code of Regulations, Title 22, 101223 (a)(3) Personal Rights is being cited on the attached LIC 9099D.
LPA Giselle Lucero informed Assistant Director Alma Coronado that this report dated 1/05/2024 documents 1 Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Giselle Lucero informed Assistant Director Alma Coronado, to provide a copy of this licensing report dated 1/05/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Exit interview conducted and report was reviewed with Assistant Director Alma Coronado A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
