Licensing Program Analyst (LPA) Giselle Lucero conducted an unannounced complaint inspection to deliver the findings for the above allegation. This is a continuation of the investigation initiated on 11/28/2023. Upon arrival LPA met with Assistant Director Alma Coronado.

Assistant director guided LPA on a tour of the facility. At 1:50 PM LPA observed a total of 35 preschool children with 4 staff.
A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Department received a complaint on 11/22/2023 alleging staff handled child in a rough manner. Reporting Party (RP) stated RP was watching the live feed on RP’s phone and saw Staff #1 (S1) pick up Child #1 (C1) by the arms and slam C1 down hard into a chair.

During the investigation LPA Lucero interviewed 3 staff members, attempted to interview C1, reviewed video footage of the alleged incident and obtained and reviewed the facility roster.

During staff interviews on 11/22/2023, S1 stated on 11/21/2023, S1 was in the classroom with children at a table. S1 observed C1 sitting in the play area on a kid’s couch. S1 stated they were trying to encourage C1 to join the rest of the group. S1 recalls trying to help C1 but C1 was fidgeting with S1 because C1 did not want to go to the tables but S1 managed to bring the child to the table. S1 stated not recalling exactly what happened. Staff #2 (S2) stated they were in the classroom the day of the alleged incident but did not see the interaction between S1 and C1. S2 made no disclosures about S1. Staff #3 (S3) stated they were made aware of the alleged incident and reviewed video footage along with Staff #4 (S4). S3 stated in the video, it was observed all the children were sitting down at the table with S1 and C1 was sitting at the kid’s couch. S1 was then observed grabbing C1’s hand and the child began sliding off the couch on to the floor in attempts to resist going with S1. S3 stated S1 still held on to C1’s hand even though the child was on the floor, and it may have appeared that C1 was being dangled. S3 also stated S1 was observed to continue to try to bring C1 over to the table and eventually was able to bring C1 to the table. S3 stated Santa Ana Police responded to the facility on 11/22/2023, reviewed the video footage of the alleged incident, interviewed the director and 2 other staff and stated police stated no child abuse was observed, a police report number was not provided.

During visit on 11/28/2023, LPA requested to obtain video footage for review. On 11/29/2023, LPA received video footage from facility staff. LPA reviewed video footage and observed S1 sitting at table with 3 children doing an activity. S1 then stands up and walks towards C1. C1 was observed sitting on a children’s couch chair in the play area. C1 picks up their feet onto the couch chair, S1 then grabbed C1 by the wrist and pulls C1 off the couch chair onto the floor. C1 is then sitting on the floor and lowers their arm in attempts to release their wrist from S1’s grip. S1 grabs C1’s wrist again and slightly tugs C1’s arm and attempts to try to get C1 to stand up. S1 releases C1’s wrist and walks away. C1 then stood up and sat on the couch chair again and then got off the chair and was kneeling on the floor in front of the couch chair. S1 is then observed returning to C1 and picking up C1 by the under-armpit area and places C1 standing and beings to walk with C1 towards the activity table while still holding onto C1’s armpit area. Once near the activity table, C1 is observed walking away from the activity table and S1 grabs C1’s left wrist to prevent C1 from walking away.

C1 then throws themselves onto the floor. S1 uses one hand to pick up C1 by the left wrist and the other hand is grabbing C1's left arm and makes C1 stand. S1 then starts moving C1 towards the activity table and pulls out a chair for C1. S1 then places right leg behind C1 pinning C1 against the table meanwhile S1 is talking to S2, C1 is observed crying and attempting to walk away. S1 then picks up C1 by the arms and sits C1 on the chair and moves the chair at an angle. S1 then grabs the chair next to C1 and scoots closer to C1 and uses their right leg to block in C1. C1 is observed crying and trying to push their way out. C1 is unable to leave from the table, as C1 is blocked by the table and S1's leg. S1 is then observed shaking their head “no” to C1 and holding onto C1's chair.

On 11/28/2023, LPA attempted to interview C1, however C1 did not qualify to be interviewed.

On 01/05/2024, LPA attempted to interview 4 children, however children were not qualified for interviews.

Based on LPA’s interviews conducted with 3 staff, RP and video footage reviewed it has been determined staff handled a day care child in a rough manner. Therefore, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated. California Code of Regulations, Title 22, 101223 (a)(3) Personal Rights is being cited on the attached LIC 9099D.

LPA Giselle Lucero informed Assistant Director Alma Coronado that this report dated 1/05/2024 documents 1 Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Giselle Lucero informed Assistant Director Alma Coronado, to provide a copy of this licensing report dated 1/05/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with Assistant Director Alma Coronado A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
